This regulation may be cited as the Electricity (Prescribed Electrical Articles) Amendment Regulation (No. 1) 1994 . ˙ Commencement 2. This regulation commences on 1 October 1994. ˙ Order amended 3. This regulation amends the Electricity (Prescribed Electrical Articles) Order 1990 . ˙ Omission of first paragraph 4. First paragraph— omit. ˙ Replacement of ss 1 and 2 5. Sections 1 and 2— omit , insert— ˙ ‘ Short title ‘ 1. This regulation may be cited as the Electricity (Prescribed Electrical Articles) Regulation 1990 . ˙ ‘ Prescribed electrical articles ‘ 2. An electrical article defined in the Schedule is a prescribed electrical article.’. ˙ Amendment of Sch A (Amended definitions) 6.(1) Schedule A, heading— omit, insert—

s6 3 s6 Electricity (Prescribed Electrical Articles) Amendment (No. 1) No. 349, 1994 ‘ SCHEDULE ‘ PRESCRIBED ELECTRICAL ARTICLES section 2’. (2) Schedule A, columns 1 and 3— omit. (3) Schedule A, column 2, heading— omit. (4) Schedule A, clause about arc welding machine— omit, insert— ‘ Arc welding machine ‘ 1. In this clause— “arc welding machine” means an electrical article that— (a) is for arc welding, whether or not with gas shielding; and (b) operates on a single phase low voltage electricity supply; and (c) is designed to be connected to the electricity supply by a flexible cord and plug, each having a rating not over 15 A; and (d) is easily moved around when connected to the electricity supply; and (e) for a flux cored, gas metal or gas tungsten arc welding machine—has a 100% output rating (calculated by multiplying the square root of the marked duty cycle by the marked output current for the duty cycle) of less than 65 A. ‘ 2. However, “arc welding machine” does not include a machine if— (a) a person sells, hires, offers, exposes or advertises the machine for sale or hire; and (b) the person makes it clear when the machine is being sold, hired, offered, exposed or advertised for sale or hire that the machine

s7 4 s7 Electricity (Prescribed Electrical Articles) Amendment (No. 1) No. 349, 1994 is— (i) an industrial machine only; or (ii) for industrial use only; or (iii) an industrial machine or for industrial use (without indicating that the machine is also a different type of machine or also has a different use). ‘ 3. An arc welding machine must comply with Australian Standard 3195. ‘ Fluorescent lamp starter ‘ 1. In this clause— “fluorescent lamp starter” means an electrical article that— (a) starts preheat type fluorescent lamps by glowing; and (b) has an enclosure of insulating material. ‘ 2. A fluorescent lamp starter must comply with Australian Standard 3138.’. ˙ Amendment of Sch B (New definitions) 7.(1) Schedule B, heading— omit . (2) Schedule B, column 1, heading— omit . (3) Schedule B, column 2— omit . (4) Schedule B, clause about gas shielded arc welding machine— omit .
