Electricity (Pacific Power) Act 1950

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Electricity (Pacific Power) Act 1950.

Explanatory note
The objects of this Regulation are:

(a) to bring all of Pacific Power’s subsidiary companies (that is, those companies in which Pacific Power has a controlling interest) under the control and direction of the Minister under section 7 of the Electricity (Pacific Power) Act 1950, and
(b) to enable the staff, assets, rights and liabilities of Pacific Power’s subsidiary companies to be transferred to other persons and bodies under clause 3 of Schedule 5 to the Energy Services Corporations Act 1995.

This Regulation is made under the Electricity (Pacific Power) Act 1950, including section 87 (the general power to make regulations), section 8E and clause 1 of Schedule 7 (the power to make regulations of a savings or transitional nature consequent on the enactment of the Energy Services Corporations Act 1995).

1     Name of Regulation

This Regulation is the Electricity (Pacific Power) (Savings and Transitional) Amendment (Subsidiary Companies) Regulation 2000.

2 Commencement

This Regulation commences on 1 July 2000.

3 Amendment of Electricity (Pacific Power) (Savings and

Transitional—Former General Manager) Regulation 1995

The Electricity (Pacific Power) (Savings and Transitional—Former General Manager) Regulation 1995 is amended as set out in Schedule 1.

4     Explanatory note

The explanatory note does not form part of this Regulation.

Omit “—Former General Manager”.

[2]     Clause 5

Insert after clause 4:

5     Application of statutory provisions to subsidiary companies

(1)  For the purposes of section 8E (1) (c) of the Act, the following
provisions are prescribed provisions:
(a) section 7 of the Act,

(b)

clause 3 of Schedule 5 to the Energy Services Corporations Act 1995.

(2) This clause expires on 1 July 2003.
