Electricity Industry Regulations Amendment (Distributed Energy Resources) Regulations 2025

Made by the Governor in Executive Council.

Part 1Preliminary1.Citation

These regulations are the Electricity Industry Regulations Amendment (Distributed Energy Resources) Regulations 2025.

2.Commencement

These regulations come into operation as follows —

  • (a)

    Part 1 — on the day on which these regulations are published on the WA legislation website;

  • (b)

    the rest of the regulations — on the day on which the Electricity Industry Amendment (Distributed Energy Resources) Act 2024 section 3 comes into operation.

Part 2Australian Energy Market Operator (Functions) Regulations 2015 amended3.Regulations amended

This Part amends the Australian Energy Market Operator (Functions) Regulations 2015.

4.Regulation 5 amended

In regulation 5(1) and (2) delete “(Wholesale Electricity Market)” and insert:

(Electricity System and Market)

Part 3Electricity Industry (Wholesale Electricity Market) Regulations 2004 amended5.Regulations amended

This Part amends the Electricity Industry (Wholesale Electricity Market) Regulations 2004.

6.Regulation 1 amended

In regulation 1 delete “(Wholesale Electricity Market)” and insert:

(Electricity System and Market)

7.Regulation 2 deleted

Delete regulation 2.

8.Regulation 3 amended
  • (1)

    In regulation 3 insert in alphabetical order:

     

market rules means the electricity system and market rules;

  • (2)

    In regulation 3 in the definition of registered participant delete “section 121(2)(a)” and insert:

     

paragraph (a) of the definition of participant in section 121(1)

9.Regulation 4A amended

In regulation 4A delete “1 October 2023.” and insert:

20 November 2024.

10.Regulation 5 amended

In regulation 5 delete “section 123(1) of the Act (the market rules).” and insert:

section 123 of the Act.

11.Regulation 7 amended

In regulation 7(5) delete “31 October 2025.” and insert:

31 October 2027.

12.Regulation 17 amended

Delete regulation 17(k).

13.Regulation 21 amended

In regulation 21(1) delete “A participant described in section 121(2)(b) or (c) of the Act” and insert:

A governance participant

14.Regulation 31 amended

Delete regulation 31(5)(c) and insert:

  • (c)

    state that the notice is given under this regulation; and

     
15.Regulation 51 replaced

Delete regulation 51 and insert:

51. Specified governance participants

In this Part —

specified governance participant means —

  • (a)

    the AEMO; and

  • (b)

    the Board.

     
16.Regulation 52 amended
  • (1)

    Delete regulation 52(1).

  • (2)

    In regulation 52(2):

    • (a)

      delete “the person’s liability to pay a civil monetary penalty” and insert:

       

    a specified governance participant’s civil monetary liability

     
    • (b)

      in paragraph (b) delete “person’s total liability (whether paid or payable) for civil monetary penalties” and insert:

       

    participant’s total civil monetary liability (whether paid or payable)

     
  • (3)

    At the end of regulation 52(3A) insert:

     

Note for this subregulation:

The reference to subregulation (2) is to that subregulation as in effect prior to the amendments made by the Electricity Industry Regulations Amendment (Distributed Energy Resources) Regulations 2025 regulation 16.

  • (4)

    In regulation 52(3):

    • (a)

      delete “The person’s total liability for civil monetary penalties” and insert:

       

    A specified governance participant’s total civil monetary liability

     
    • (b)

      delete “person’s liability to a civil monetary penalty” and insert:

17.Regulation 53 amended

In regulation 53:

19.Regulations 55A and 55B inserted

At the end of Part 10 insert:

55A. Prescribed voltage (Act s. 3(1))

For the purposes of the definition of prescribed voltage in section 3(1) of the Act, the voltage is 66 kV.

55B. System voltage (Act s. 124B)

  • (1)

    This regulation applies in relation to distribution systems.

  • (2)

    A network operator must, to the extent practicable, maintain a system voltage, at the points where the electricity will pass beyond the service apparatus of the network operator, as follows —

    • (a)

      for a point in relation to which an agreement with the network operator deals with the voltage of the electricity supplied at that point — as specified or provided for in the agreement;

    • (b)

      otherwise —

      • (i)

        for single‑phase connections — between 207 V and 254 V; or

      • (ii)

        for three‑phase connections — between 360 V and 440 V.

  • (3)

    A network operator must take all reasonable steps to limit the extent and duration of voltage excursions.
