Made by the Governor in Executive Council.

1.   Citation

This order is the Electricity Industry Exemption Amendment

2352 GOVERNMENT GAZETTE, WA 25 March 2022

2.   Commencement

This order comes into operation as follows —

(a)	clauses 1 and 2 — on the day on which this order is published in the Gazette;
(b)	the rest of the order — on the day after that day.

3. Order amended

This order amends the Electricity Industry Exemption

Order 2005.

4.            Clause 30 inserted

After clause 29 insert:

30.         Exemption for sale of electricity — Pilbara Energy Connection

(1) In this clause —

FMG entity means —

(a)	Fortescue Metals Group Ltd (ACN 002 594 872); and
(b)	a body corporate that is related to Fortescue Metals Group Ltd (ACN 002 594 872) under the Corporations Act 2001 (Commonwealth) section 50.

(2) An FMG entity is exempt from the Electricity Industry

Act 2004 section 7(4) in relation to the sale of

electricity transported, or to be transported, by the

Pilbara Energy Connection to —

(a)	IB Operations Pty Ltd (ACN 165 513 557); or
(b)	another FMG entity.
