Electricity Industry (Confidentiality of Information) Regulations 2000

1Objective

The objective of these Regulations is to make provision for the confidentiality of information that VENCorp receives from a licensee about any past or likely future insufficiency in the supply of electricity.

2Authorising provisions

These Regulations are made under sections 83 and 119 of the Electricity Industry Act 2000.

3Commencement

These Regulations come into operation on 1 January 2001.

4Definition

In these Regulations Act means the Electricity Industry Act 2000.

5Application of Regulations

These Regulations apply if—

(a)VENCorp receives information from a licensee about any past or likely future insufficiency in the supply of electricity; and

(b)at the time the information was given, the licensee stated that the information was of a confidential or commercially-sensitive nature.

6Disclosure

If VENCorp gives information to which these Regulations apply to the Minister under section 83 of the Act, the Minister—

(a)may disclose that information to any other Minister or to any person engaged in the administration of Part 4 of the Act; and

(b)must not, without the consent of the licensee who gave it, disclose that information to any other person.

7Minister to advise VENCorp of persons to whom information is disclosed

The Minister must advise VENCorp of the name of any person to whom the Minister discloses information under regulation 6(a).

8Restrictions on disclosure

A person to whom the Minister discloses information under regulation 6(a) must not, without the consent of the licensee who gave the information, disclose that information to any person other than a Minister or a person engaged in the administration of Part 4 of the Act.

9Licence conditions

Nothing in these Regulations limits disclosure or use of the information by VENCorp in accordance with any condition of a licence.

1.     General Information

The Electricity Industry (Confidentiality of Information) Regulations 2000, S.R. No. 137/2000 were made on 19 December 2000 by the Governor in Council under sections 83 and 119 of the Electricity Industry Act 2000, No. 68/2000 and came into operation on 1 January 2001: regulation 3.

The Electricity Industry (Confidentiality of Information) Regulations 2000 will sunset 10 years after the day of making on 19 December 2010 (see section 5 of the Subordinate Legislation Act 1994).
