An Act to amend the Electricity Feed-in (Large-scale Renewable Energy Generation) Act 2011

The Legislative Assembly for the Australian Capital Territory enacts as follows:

1. Name of Act

   This Act is the Electricity Feed-in (Large-scale Renewable Energy Generation) Amendment Act 2020.

2. Commencement

   This Act commences on the day after its notification day.

   NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

3. Legislation amended

   This Act amends the Electricity Feed-in (Large-scale Renewable Energy Generation) Act 2011.

4. New section 22A

   insert

22ADisapplication of certain provisions

(1)The relevant determination is taken to have commenced on 11 November 2019 (the deemed commencement day).

(2)The Legislation Act, section 65 (Disallowance by resolution of Assembly) does not apply to the relevant determination.

(3)Section 11 (3) and (4) do not apply to a FiT entitlement granted under a FiT capacity release made under the relevant determination.

(4)To remove any doubt, any act done on or after the deemed commencement day and before the notification day of the relevant determination in reliance on the relevant determination having been validly made, is taken to have been validly done.

NoteThe validating effect of s (4) does not end only because of the repeal of this section (see Legislation Act, s 88 (1)).

(5)In this section:

relevant determination means the Electricity Feed-in (Large-scale Renewable Energy Generation) FiT Capacity Release Determination 2020 (No 1) (DI2020-250) notified on the ACT legislation register on 24 August 2020.

(6)This section expires the day after the 6th sitting day after 27 August 2020.
