Electricity Distribution Amendment

Regulations (No. 2) 2001

Made by the Lieutenant-Governor and deputy of the Governor in
Executive Council.

1.            Citation

For amendments to 14 December 2001 see 2000 Index to
Legislation of Western Australia, Table 4, p. 83, and Gazette
28 September 2001.]

These regulations may be cited as the Electricity Distribution
Amendment Regulations (No. 2) 2001.

2.            Commencement

These regulations come into operation on the day on which they are published in the Gazette.

3.            The regulations amended

The amendments in these regulations are to the Electricity
Distribution Regulations 1997* .

4.            Regulation 3 amended

Regulation 3 is amended as follows:

(a) by inserting in its appropriate alphabetical position the following definition

"renewable energy source" means an energy source

other than a fossil fuel or a man-made nuclear

fission process;

(b) "Electricity Corporation established under" and inserting

in the definition of "Western Power", by deleting " Western Power Corporation referred to in ".

5.            Regulation 12 amended

Regulation 12 is amended as follows:

(a)	in subregulation (5)(a), by inserting before "user"
44 a ”;
(b)	in subregulation (6), by inserting after "user" — " to ".

6.            Regulation 19 amended

Regulation 19 is amended as follows:

(a)	by repealing subregulation (2);
(b)	in subregulation (6), by deleting "Subject to subregulation (2), a" and inserting instead

7.            Regulation 22 amended

(1)	Regulation 22 is amended by inserting before "The loss factor" the subregulation designation "(1)".
(2)	Regulation 22(a) is deleted and the following paragraph is inserted instead

(a) on the interconnected network is —

(i) connection, the factor determined by

unless subregulation (2) applies to the out in Schedule 4;

(ii)

if subregulation (2) applies to the calculated under that subregulation;

(3) Regulation 22 is amended by inserting at the end of the

regulation the following subregulation -

(2) Western Power may —

(a)	in the Prices and Charges Paper, specify certain distribution connections on the interconnected network that are exit points as constituting a category for the purposes of this subregulation; and
(b)	from time to time calculate an average loss factor for the connections specified as constituting a category.

8.            Regulation 23 amended

Regulation 23(e)(ii) is deleted and the following subparagraph is inserted instead —

" (ii) 500kWh; ".

9.            Regulations 24 and 25 amended

Before each of regulations 24(1) and 25(1), the following subregulation is inserted —

(laa) This regulation does not apply to a distribution access agreement for transporting electricity any of which is derived from a renewable energy source, but that does not prevent the agreement from dealing with matters of

the kind dealt with in this regulation.

10.          Regulation 26 amended

Before regulation 26(1), the following subregulation is

inserted -

(laa) This regulation does not apply to a user whose

distribution access agreement is for transporting
electricity any of which is derived from a renewable
energy source, but that does not prevent the agreement
from dealing with matters of the kind dealt with in this
regulation.

11.          Regulation 27 amended

(1) Before regulation 27(1), the following subregulation is

inserted —

(laa) This regulation does not apply to a distribution access
agreement for transporting electricity any of which is

derived from a renewable energy source, but that does
not prevent the agreement from dealing with matters of

the kind dealt with in this regulation.

(2) Regulation 27(1) is amended by deleting "an amount equal to

3% of the relevant amount" and inserting instead —
" the permitted tolerance ".

12.          Regulation 41 amended

Regulation 41(3) is amended by inserting after "Part 4" —

or otherwise for the use of any distribution access
service other than in accordance with the distribution
access agreement

13.          Regulation 45 amended

Regulation 45(3) is amended by deleting "the operation of
Part 4" and inserting instead

an obligation of the user, arising under Part 4 or
otherwise, to pay any charge relating to the transport of
the electricity

14.          Schedule 2 amended

Schedule 2 Part A paragraph (c) is amended by deleting "kVa" and inserting instead —

" kVA ".
