ELECTRICITY CORPORATION (CHARGES) BY-LAWS 1996

Made by the Electricity Corporation with the approval of His Excellency the

Governor in Executive Council.

Citation

1.      These by-laws may be cited as the Electricity Corporation (Charges)

By-laws 1996.

Commencement

2.      These by-laws come into operation on 1 July 1996.

Interpretation

3.      In these by-laws, unless the contrary intention appears -

" means a house, flat, home unit or other place of residence

'dwellinin% use solely for residential purposes;

"half-hourly maximum demand" means the maximum demand in

kilowatts recorded during the accounting period concerned in any
period of half an hour;

"maximum endorsed indust rice of automotive distillate", in
relation to a charge spec1 P! ie in Schedule 1 or 2, means the sum

of the arithmetic average of -

(a) the maximum endorsed company prices for automotive distillate; and
(b) automotive distillate,

the State Government franchise fees and supplements for immediately preceding the quarter in which the electricity was

in Perth, using the figures in force a t the first day of the month

supplied, as published by the Australian Competition and Consumer Commission under the Prices Surveillance Act 1983 of the Commonwealth;

'off peak" means any period other than on peak;

eak" means the periods between 8.00 a.m. and 10.00 p.m.

'On % onday to Friday;
'Pilbara power system" means the electrical system from which electricity enerated a t one or more of the ower stations a t Dam ier, cape Lambert and Port ~edlancf respectively, is supp P ied to consumers;

Uquarter" means a period of 3 months commencing on 1 July,

1 October, 1 January or 1 April;

"regional power system" means any electrical system of or conducted by the Electricity Corporation from which electricity is supplied to consumers, other than the South West interconnected system and the Pilbara power system;

"residential tariff" means Tariff Al, B1 or A2;

USouth West interconnected system" means the electrical system from which electricity enerated a t one or more of the power stations a t Kwinana, &,aja. Bunbury and Pinjar, respectively, is supplied to consumers;

"Tariff followed by a designation means the tariff so designated in

Schedule 1 or 2;

"unit", in relation to a charge for electricity, means one kilowatt hour.

Electricity charges

Electricity Corporation - (1) The charges to be paid by consumers for electricity supplied by the

(a) from an part of the South West interconnected system, are those

specifie B in, or calculated in accordance with, Schedule 1;

from any part of the Pilbara power system or fr0.m a re 'onal

(b) power S stem, are those specified in, or calculated in accor ance T
with, Sc edule 2; K
(c) partly from one S stem, and partly from another system referred
to in paragraph 6) or (b), are those calculated by the B!lectricity Corporation on the basis of Schedules 1 and 2 according to the

source of supply from time to time; and

(d) in respect of street lighting, are those specified in Schedule 3.

(2) Any question as to which source of supply was utilized is to be

determined by the Electricity Corporation.

Application of residential tariffs

b. (1) A consumer is entitled to be supplied on the basis of a residential tariff only if -

(a) the premises supplied consist of a dwelling; and
(b) the su ply is not used for any industrial, commercial, business, or
genera purpose. S
Notwithstanding that any premises would not otherwise be treated applied if the premises or any art of the premises is independently supplied
as a dwelling for the purposes of this by-law, a residential tariff may be (2)
and separately metered solely or the purpose of a residential supply. P

Meter rental

6. (1) A consumer supplied by the Electricit Corporation with electricity

is liable to pay the rental specified in Schedule l i n respect of each subsidiary
meter used to meter the supply.

(2) Sub-bylaw (1) does not apply to a consumer if -
(a) the premises supplied consist of a dwelling;
(b) the su ply is not used for any industrial, commercial, business, or
genera purpose; and 9
(C) the master account is supplied under a residential tariff.

Fees

7. The fees specified in Schedule 5 are payable in respect of the matters specified in that Schedule.

Payment

8. (1) A consumer sup lied by the Electricity Corporation must ay the appropriate charges spec1 led in the Schedules within 14 days of Lmand

Rebates and reduced fees

9. (1) Where electricity is supplied to a consumer who is an eligible person, for use at his or her principal

(5) In this by-law -

'eligible person" means a person who satisfies the Electricity Corporation that the person holds -

(a) a -
(i) Health Care Card;
(ii) Health Benefits Card; or

(iii) Pensioner Concession Card,

issued by the De artment of Social Security of the
Government of the dbmmonwealth;
(b) a Repatriation Health Card, issued b the Department of Veterans' Ma i r s of the Government ot the Commonwealth that indicates on i t that the person is totally and permanently incapacitated, a war widow or a dependant; or
(C) a Seniors' Card issued by the m i c e of Seniors' Interests of
the Government of the State.
Calculation of charges
10. (1) Where a charge per unit specified in Schedule 1 or 2, de ends on
the number of units consumed per day the charge per unit is to be g ased on
the average daily consumption in the accounting period.

Change in rates

11. Where during any accounting period a change in the applicable rate of char es occurs the charge payable may be a&usted by reference to the date on wkch the change is to take effect or by reference to the date on which the change is applied to any applicable account whichever results in the lower charge.

Prescribed rate of interest under section 62 (16) of the Act

12. For the purposes of section 62 (16) of the Act the rate at which interest is to be paid, or gwen credit for, by the Electricity 6orporation is 7.8%.

TARIFF L1

General Supply

LowlMedium Voltage Tariff

This tariff is available for low/medium voltage supply.
A fixed charge a t the rate of 24.31 cents per day.

Plus all metered consumption at the rate of -

15.98 cents per unit for the first 1 650 units per day.

14.42 cents per unit per day for all units exceeding 1 650 units.

TARIFF M1

General Supply

High Voltage Tariff

This tariff is available for consumers su lied at 6.6kV, IlkV, 22kV or 33kV

or such higher voltage as the Electricity ErPOration may approve.
A fixed charge at the rate of 24.31 cents per day.

Plus all metered consumption at the rate of -

15.44 cents per unit for the first 1 650 units per day.
13.87 cents per unit per day for all units exceeding 1 650 units.

TARIFF R1

Time of use Tariff

Demand charge 53.35 cents per day multiplied by -

the on peak half-hourly maximum demand; or

(a) on peak energy charge 7.65 cents per unit;
(b) off peak energy charge 4.84 cents per unit.

Conditions for Tariff S1

Minimum period of contract

Consumer to agree to take the tariff for a minimum period of 12 months.

Power factor

Power factor is to be 0.8 or better during the on peak period.

The Electricit CO oration reserves the right to levy a charge of 37.57 cents

(a) the on peak half-hourly maximum demand; or

whichever is the greater.

Energy charge -

(a) on peak energy charge 6.96 cents per unit;
(b) off peak energy charge 4.64 cents per unit.

Conditions for Tariff T1

Minimum perid of contract

Consumer to agree to take the tariff for a minimum period of 12 months.

Ownership of high voltage equipment

This tariff applies to consumers who own all equipment except tariff metering equipment on the load side of the consumer's high voltage terminals.

Power factor
Power factor is to be 0.8 or better during the on peak period.

Minimum charge a t the rate of $440.00 per day.

Demand charge of 36.97 cents per day multiplied by -

(a) the on peak half-hourly maximum demand; or
(b) 30% of the off peak half-hourly maximum demand,

whichever is the greater.

Energy charge -

(a) on peak energy charge 6.53 cents per unit;
(b) off peak energy charge 4.33 cents per unit.

Conditions for Tariff U1

This tariff a plies a t the discretion of the Electricity Corporation to the supply of efktricity taken a t 66kV or 132kV from the South West

interconnected s stem, to consumers who have entered into a contract with the Electricity d oration which provides inter dia for the establishment of

a sub-station joint 'P y owned by the consumer and the Electricity Corporation or for the payment by the consumer, of a capital contribution, as determined
by the Electricity CO oration, towards the cost of providing a sub-station to
be fully owned by the 'E lectricity Corporation.
Consumers seeking supply under this tariff ma also be required to

(i)       maximum demand; or

(ii)     total half-hourly maximum demand and registered half- hourly maximum demand,

whichever is less.

In the case of Tariff M1.

Standby charge - 4.76 cents per day per kW.
Based on the difference between total half-hourly maximum

demand and normal half-hourly maximum demand.

In the case of Tariff T1.

Standby charge - 4.76 cents per day per kW.

Based on the difference between -

total half-hourly maximum demand and normal half-hourly

(i)       maximum demand; or

(ii)     total half-hourly maximum demand and registered half- hourly maximum demand,

whichever is less.

(e) In the case of Tariff U1.
standby charge - 3.70 cents per day per kW.

Based on the difference between either -

the consumer's contract maximum demand and the on peak

(i) half-hourly maximum demand registered in any accounting

period; or

(ii)      in the event that the consumer's contract for supply with the Electricity Corporation does not contain provision for a

contract maxlmum demand, the total half-hourly maximum demand and the on peak half-hourly maximum demand registered in any accounting period.

Conditions for provision of standby service

The consumer to ay for the cost of all additional mains and equipment

be for a minimum period of 12 months. Thereafter the consumer will be necessary to provi B e the standby service. The standby service agreement will
required to give 6 months notice in writing to the Electricity Corporation of
intention to terminate the agreement.

The "normal half-hourly maximum demand" will be assessed b the Electricity CO oration and will be based on loading normally supplieBfrom

the ~1ectricit~Forporation's supply.

Notwithstanding the Electricity Corporation's assessment, in any accounting period the normal half-hourly maximum demand shall be taken to be not less than -

The "total half-hourly maximum demandn will be assessed by the Electricity Corporation as the consumer's expected half-hourly minimum demand on the Electricity Corporation's system without the consumer's generation equipment in operation.

The difference between total half-hourly maximum demand and normal half-

hourly maximum demand will not exceed -

(a) the capacity of the consumer's generation equipment; or
(b) the expected maximum loading of such generation equipment, as

assessed by the Electricity Corporation.

TARIFF A1

Residential tariff

This tariff is available for residential use only.

A fixed charge at the rate of -

22.54 cents per day.

Plus all metered consumption at the rate of -

12.29 cents per unit.

For multiple dwellings supplied through one metered supply point the fixed charge is at the rate of -

(a) 22.54 cents per day for the first dwelling; and
(b) 18.17 cents per day for each additional dwelling.

TARIFF B1

Reeidential Water Heading Tariff

This tariff is available for residential water heating during a 6 hour period between the hours of 11.00 p.m. and 6.00 a.m. for installations approved by the Electricity Corporation. Other single phase hardwired appliances may be connected in conjunction with the water heater.

A fixed charge at the rate of -

11.75 cents per day.

Plus all metered consumption at the rate of -

6.50 cents per unit.

For multiple dwellings supplied through one metered supply point the fixed charge is at the rate of -

11.75 cents per day for each dwelling supplied.

TARIFF C1

Special Community Service Tariff

This tariff is available for small voluntary and charitable organizations, subject to the undermentioned conditions.

Fixed charge at the rate of 22.54 cents per day. Plus all metered consumption at the rate of -

12.29 cents er unit for the first 20 units per day.
15.98 cents or the next 1 630 units per day. F

14.42 cents per unit per day for all units exceeding 1 650 units.

Conditions fo r Tariff C1

For the purposes of this tariff the consumer must comply with the following conditions.

(1) The consumer must -
(a) be a direct customer of the Electricity Corporation;
(b) be a voluntary, non-profit making organization;

be classified a s bein tax exempt under section 23 of the Income
Tux Assessment Act I 936 of the Commonwealth;
(d) provide a public service, which is available to any member of the

public without discrimination;

not be a Commonwealth, State or local government department,

(e) instrumentality or agency; and

Special Tariff for Certain Premises

This tariff is available for premises wholly used by a charitable or benevolent organization for providing residential accommodation other than for commercial gain, being premises for which tariff A1 is not available.

A fixed charge a t the rate of -

22.54 cents per day,

and where in accordance with this tariff there is deemed to be more than one

equivalent domestic residence in the premises, an additional -

18.17 cents per day,

for each equivalent domestic residence except the first that is deemed to be in

the premises.

Plus all metered consumption a t the rate of -

12.29 cents per unit.

For the purposes of this tariff the number of equivalent domestic residences to be in articular premises is ascertained by dividing the facility's total bed

capacity y 5 and, where the uotient is not a whole number, by increasing i t
to the next highest whole num er. %

TARIFF K1

General Supply with Residential Tariff

This tariff is available for premises where the circuit wiring is not se arate

residential purposes. and the electricity is used partly for general purposes and party for P
