Electricity (Consumer Safety) Act 2004

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Electricity (Consumer Safety) Act 2004.

Explanatory note
The object of this Regulation is to amend the Electricity (Consumer Safety) Regulation 2006
to:

(a) prescribe certain offences under the Electricity (Consumer Safety) Act 2004 that relate to the sale of electrical articles as penalty notice offences, and
(b) increase the penalty notice amount for the sale of an electrical article that is not marked in accordance with that Regulation from $200 to $500.

This Regulation is made under the Electricity (Consumer Safety) Act 2004, including section 47 and section 55 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Electricity (Consumer Safety) Amendment
(Penalty Notice Offences) Regulation 2009.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Electricity (Consumer Safety) Regulation 2006

Schedule 3 Penalty notice offences

Omit the matter relating to section 16 (1) (b) under the heading

Offences under the Act”.

Insert instead:

Section 16 (1) (a), (b) or (c) $500
