An Act to amend the Electricity Commission Act 1950 with respect to the constitution of the Electricity Commission. [Assented to 14 March 1989]
Electricity Commission (Amendment) 1989
The Legislature of New South Wales enacts:
Short title
1. This Act may be cited as the Electricity Commission (Amendment) Act 1989.
Commencement
2. This Act commences on a day or days to be appointed by
proclamation.
Amendment of Electricity Commission Act 1950 No. 22
3. The Electricity Commission Act 1950 is amended as set out in Schedule 1.
Savings, transitional and other provisions
4. Schedule 2 has effect.
SCHEDULE 1—AMENDMENTS
(Sec. 3)
(1) Section 5A (Provisions relating to the membership and procedure of
Commission)—
Section 5A (1)— less than 6 and not more than 8".
(2) Schedule 6, clause 2 (Commissioners)—
(a) Omit clause 2 (1) (a) and (b), insert instead:
(a)
1 shall, in and by the instrument by which the commissioner is appointed, be appointed as General Manager of the Commission;
(b)
not less than 4 and not more than 6 shall be persons nominated for appointment as commissioners by the Minister and shall, in and by the instruments by which they are appointed, be appointed as part-time commissioners; and

(3) Schedule 7 (Provisions relating to the procedure of the Commission),
clause 2 (Quorum)—
Omit "Five commissioners (or 6 if there are more than 8", insert instead "Three commissioners (or 4 if there are more than 6".
SCHEDULE 2—SAVINGS, TRANSITIONAL AND OTHER PROVISIONS
(Sec. 4)
Amendments relating to constitution of Electricity Commission
(1) The person holding office as General Manager of the Electricity Commission immediately before the commencement of Schedule 1 (2) (a) shall be taken to have been appointed as a commissioner and as General Manager of the Commission under the Electricity Commission Act 1950 as amended by this Act for the balance of the person's term of office.

(2) A person holding office as an appointed part-time commissioner of the Electricity Commission immediately before the commencement of Schedule 1 (2) (a)—
• (a) ceases to hold office as such on that commencement; and
| (b) | is eligible (if otherwise qualified) to be a part-time commissioner of the |
Commission.
(3) A person who ceases to hold office as a commissioner of the Electricity Commission because of the operation of this Act is not entitled to be paid any remuneration or compensation because of so ceasing to hold that office.
