Electricity Amendment Regulations (No. 5) 2009
Made by the Governor in Executive Council.
1. Citation
These regulations are the Electricity Amendment Regulations
(No. 5) 2009.2. Commencement
These regulations come into operation as follows —
(a) regulations 1 and 2 — on the day on which these regulations are published in the Gazette; (b) the rest of the regulations — on the day after that day. 3. Regulations amended
These regulations amend the Electricity Regulations 1947.
4. Regulation 2 amended
In regulation 2(1) in the definition of Australian/New Zealand
Wiring Rules:
(a) delete “AS/NZS 3000:2000 Electrical Installations” and insert: AS/NZS 3000:2007 Electrical installations
(b) delete “New Zealand.” and insert: New Zealand, as amended from time to time.

5. Regulation 12 amended
In regulation 12 delete the definition of residential premises and
insert:residential premises means premises that constitute or
are intended to constitute a place of residence but does
not include any common property relating to the
residential premises;
6. Regulation 15 amended
In regulation 15 delete “the property” and insert:
the common property
7. Regulation 18 inserted
After regulation 17 insert:
18. Director may grant temporary exemptions
(1) The Director may, by notice in writing, exempt an
owner of residential premises from the requirements of
regulation 13, 14 or 15, for such period, and on such
conditions, as the Director considers appropriate and
are set out in that notice.(2) The Director must not grant an exemption under
subregulation (1) unless the Director is satisfied that —
(a) there are special circumstances which justify exempting the owner from the requirements of regulation 13, 14 or 15, as the case requires; and (b) those circumstances are temporary; and (c) the exemption will not cause or allow to continue any undue risk of — (i) injury to a person; or (ii) damage to property.
