s1 3 s4 Electricity Amendment (No. 5) No. 349, 1998 ˙ Short title 1. This regulation may be cited as the Electricity Amendment Regulation (No. 5) 1998 . ˙ Regulation amended 2. This regulation amends the Electricity Regulation 1994 . ˙ Amendment of s 7 (Functions of EWC Board) 3. Section 7(i), ‘regulator’— omit, insert— ‘Minister’. ˙ Amendment of s 10 (Composition of EWC Board) 4.(1) Section 10(1), ‘5’— omit, insert— ‘6’. (2) Section 10(3)(a)— omit, insert— ‘(a) the Queensland Utilities and Services Industry Training Advisory Board;’. (3) Section 10(3)(d), after ‘Association’— insert— ‘of’. (4) Section 10(3)— insert— ‘(f) any other entities, together as a group, that the Minister decides represent the interests of customers.’.

Section 20(2), ‘immediately’— omit, insert— ‘, as soon as practicable,’. ˙ Omission of s 25 (Payment of EWC Board’s expenses) 6. Section 25— omit. ˙ Insertion of new s 26AA 7. Chapter 2, part 1, after section 26— insert— ˙ ‘ Annual report ‘ 26AA. The EWC Board must, as soon as practicable after the end of each financial year, give to the Minister a copy of its annual report for the financial year.’. ˙ Amendment of s 32 (Exemptions from being electrical contractors) 8. Section 32(5A), ‘appliance’— omit, insert— ‘article’. ˙ Amendment of s 51 (Renewal of licence for electrical workers) 9. Section 51(1), from ‘if’— omit, insert— ‘if— (a) the holder— (i) applies in the approved form; and

s 10 5 s 11 Electricity Amendment (No. 5) No. 349, 1998 (ii) pays the prescribed fee; and (iii) gives to the board evidence that the holder has successfully finished a course of electrical safety and resuscitation training approved by the board; and (b) the board is satisfied the holder is qualified under the regulation to hold the licence.’. ˙ Amendment of s 60 (Financial and insurance requirements for electrical contractors) 10.(1) Section 60, ‘$1 000 000’— omit, insert— ‘$5 000 000’. (2) Section 60— insert— ‘ (2) The public liability insurance must be by way of a contract of insurance approved by the EWC Board.’. ˙ Amendment of s 62 (Renewal of electrical contractors’ licences) 11.(1) Section 62(1) and (2)— omit, insert— ‘ 62.(1) The EWC Board must renew an electrical contractor’s licence if, before the licence ends— (a) the holder of the licence— (i) applies in the approved form for its renewal; and (ii) pays to the board the prescribed fee; and (iii) gives to the board evidence that the holder has successfully finished a course of business and technical training approved by the board; and (b) the board is satisfied the holder is qualified under the regulation to hold the licence.’.

Section 63(1)(a)— insert— ‘(iii) gives to the board evidence that the holder has successfully finished a course of business and technical training approved by the board; and’. ˙ Omission of ss 82, 84 and 85 13. Sections 82, 84 and 85— omit. ˙ Amendment of s 83 (Existing certificates of competency and permits) 14. Section 83— insert— ‘ (2) Despite subsection (1), the term of a licence or permit to which subsection (1) applies is extended until the first birthday of the holder of the licence or permit that happens after 30 June 1999.’. ˙ Amendment of s 86 (Expiry of division) 15. Section 86, ‘1 January 1999’— omit, insert— ‘1 July 2000’. ˙ Amendment of s 134 (Scaffolding and portable ladders) 16. Section 134(1), from ‘with’—

Chapter 3, part 2, division 5 heading— omit, insert— ‘ Division 5—Electricity Health and Safety Council ’. ˙ Amendment of s 142 (Electricity Industry Safety Advisory Committee) 18.(1) Section 142, heading— omit, insert— ‘ Electricity Health and Safety Council ’. (2) Section 142(1)— omit, insert— ‘ 142.(1) The name of the Electricity Safety Advisory Committee is changed to the Electricity Health and Safety Council (the “council” ). 1 ’. (3) Section 142(2) and (3), ‘committee’— omit, insert— ‘council’. (4) Section 142(3), ‘issues about the safety of persons engaged in electrical work’— 1 The Electricity Safety Advisory Committee was established under the previous section 142(1).

Chapter 3, part 3, division 3, after section 157— insert— ˙ ‘ Operation of electricity line beyond person’s property—Act, s 227 ‘ 157A. A person, other than an electricity entity or special approval holder, must not operate an electric line beyond the person’s property unless the person has written approval from the regulator to operate the line.’. ˙ Amendment of s 169 (Certificate of testing and compliance) 20. Section 169(1)— omit, insert— ‘ 169.(1) A person who connects an electrical installation on which electrical installation work or repair work has been performed to a source of electricity supply must give a certificate about the test done under section 144(1A)(b) 2 to the customer as soon as practicable after the connection. ‘ (1A) The certificate must state the following— (a) the name and address of the customer; (b) the electrical installation work or repair work tested; (c) the day the work electrical installation or repair work was tested; (d) the number of the electrical contractor’s licence under which the electrical installation work or repair work was tested.’. 2 Section 144 (Electrical installation not to be connected to electricity source if work not tested)

(2) Section 182(4), ‘this’— omit. ˙ Amendment of s 192 (Further tests during period of registration of system) 22. Section 192(2), ‘during the third year of the registration’— omit, insert— ‘at least once in every 3 years after the day of registration’. ˙ Amendment of s 198 (Maximum potential change etc.) 23. Schedule 7, part 1, item 6, ‘150.00’— omit, insert— ‘200.00’. ˙ Amendment of sch 8 (Dictionary) 27.(1) Schedule 8, definitions “AS” and “PSME schedule” — omit. (2) Schedule 8— insert— ‘ “AS” means a Standards Australia standard. “AS/NZS” means a joint Standards Australia and Standards New Zealand standard.’.
