Electricity Amendment Regulation (No. 4) 2012 [s 1] 1 Short title This regulation may be cited as the Electricity Amendment Regulation (No. 4) 2012 . 2 Regulation amended This regulation amends the Electricity Regulation 2006 . 3 Insertion of new ch 2, pt 4 hdg After section 30— insert— ‘Part 4 Small customers’ small photovoltaic generators ’. 4 Amendment of s 30AA (Prescribed amount for credit for electricity produced by small photovoltaic generators) (1) Section 30AA, before ‘amount’— insert— ‘credit’. (2) Section 30AA— insert— ‘(2) A small customer— (a) mentioned in subsection (1)(a) is a category 1 small customer ; or (b) mentioned in subsection (1)(b) is a category 2 small customer . ‘(3) For section 44A(2)(b) of the Act, the day prescribed for a category 2 small customer is 30 June 2014. ‘(4) For section 335(5) of the Act— (a) the day prescribed is 30 June 2014; and Page 2 2012 SL No. 211
Electricity Amendment Regulation (No. 4) 2012 [s 5] (b) the prescribed credit amount is $0.08 for each kilowatt hour.’. 5 Insertion of new s 30AB Chapter 2, after section 30AA— insert— ‘30AB When a small customer stops being entitled to be credited with prescribed credit amount for a category 1 small customer ‘(1) A small customer stops being entitled to be credited with the prescribed credit amount under section 44A(1)(b) of the Act for a category 1 small customer in relation to a qualifying generator that is connected to a distribution entity’s supply network if the name on the electricity account for the premises is changed to another person. Example of when the name on an electricity account may be changed The premises are sold or rented out. ‘(2) Subsection (1) does not apply if the small customer’s spouse was a category 1 small customer for the premises immediately before the small customer became a small customer for the premises. ‘(3) A small customer also stops being entitled to be credited with the prescribed credit amount under section 44A(1)(b) of the Act for a category 1 small customer if— (a) no qualifying generator has been connected at the small customer’s premises to a distribution entity’s supply network by the end of 30 June 2013; or (b) no qualifying generator is ready to be connected at the small customer’s premises to a distribution entity’s supply network by the end of 30 June 2013. ‘(4) If a small customer stops being entitled to be credited with the prescribed credit amount under section 44A(1)(b) of the Actfor a category 1 small customer, the small customer— (a) is taken to be a category 2 customer; and 2012 SL No. 211 Page 3
