s1 3 s5 Electricity Amendment (No. 4) No. 220, 1997 ˙ Short title 1. This regulation may be cited as the Electricity Amendment Regulation (No. 4) 1997 . ˙ Regulation amended 2. This regulation amends the Electricity Regulation 1994 . ˙ Amendment of s 5 (Words have the same meaning as in wiring rules) 3. Section 5(1), ‘chapter 3’— omit, insert— ‘this regulation’. ˙ Amendment of s 10 (Composition of EWC Board) 4.(1) Section 10(1), ‘5 members’— omit, insert— ‘at least 5 other members’. (2) Section 10— insert— ‘ (1A) At least half of the members of the board must have the qualifications set out in subsection (2).’. (3) Section 10(2), from ‘A person’ to ‘the person is’— ‘The qualifications for subsection (1A) are that a person must be’. ˙ Insertion of new s 26A 5. Part 2, division 1, after section 26— insert— ˙ ‘ Definition for div 1 ‘ 26A. In this division—
s6 4 s8 Electricity Amendment (No. 4) No. 220, 1997 “electrical work” does not include the work of installing or repairing telecommunications cabling.’. ˙ Amendment of s 27 (Electrical work to be done by holder of licence or permit) 6. Section 27(1)— omit, insert— ‘ 27.(1) A person must not— (a) perform electrical work; or (b) connect, disconnect, interfere with or remove a fixed part of an electrical installation; unless the person acts under the authority of a licence or permit. Maximum penalty—20 penalty units.’. ˙ Amendment of s 32 (Exemptions from being electrical contractors) 7.(1) Section 32(2)(d)— omit. (2) Section 32— insert— ‘ (5A) A person may perform work repairing an electrical appliance, or replacing an electrical appliance with a similar type, if the person is authorised under the Act to perform the work.’. ˙ Amendment of s 67 (Grounds for disciplinary action against holder of electrical worker’s licence or permit) 8. Section 67(d)— omit, insert— ‘(d) the holder has contravened a condition to which the licence or permit is subject.’.
s 9 5 s 10 Electricity Amendment (No. 4) No. 220, 1997 ˙ Amendment of s 80 (Advertising by licensed electrical contractors) 9. Section 80(b), ‘this Act’— omit, insert— ‘the Act’. ˙ Insertion of new s 116A 10. After section 116— insert— ˙ ‘Clearing and lopping of trees on non-freehold land ‘ 116A.(1) An electricity entity may clear or lop trees growing on non–freehold land if— (a) it is necessary to do so to build, maintain or operate an electric line or works on the land; and (b) an easement, wayleave or other agreement in relation to the line or works is in place. ‘ (2) Subsection (1) applies subject to— (a) the conditions of the easement, wayleave or agreement; and (b) section 118. ‘ (3) Subsection (1) does not limit any rights an electricity entity has under an agreement with an owner of freehold land in relation to clearing or lopping trees on the land. ‘ (4) In this section— “clear” see Land Act 1994. “lop” see Land Act 1994. 1 “trees” see Land Act 1994.’. 2 1 The Land Act 1994 , section 253 defines “lopping”. 2 “Tree” in the Land Act 1994 currently has the same meaning as in the ForestryAct 1959.

Section 131, table, from ‘275 kV’ to ‘4.0 m’— omit, insert— ‘220 kV 1.8 m 275 kV 2.2 m 330 kV 2.8 m more than 330 kV 4.0 m’. ˙ Amendment of s 139 (Signs on switches and disconnection points) 12. Section 139(2), ‘AS 1319–1983’— omit, insert— ‘AS 1319–1994’. ˙ Amendment of s 144 (Electrical installation not to be connected to electricity source if work not tested) 13.(1) Section 144(1), from ‘if’ to ‘regulator’— omit. (2) Section 144— insert— ‘ (1A) Subsection (1) does not apply if— (a) the work has been performed by— (i) a licensed electrical mechanic under section 32(2)(a); or (ii) a person under section 32(5A); or (iii) under the authority of a licensed electrical contractor; and (b) the work has been tested in the way approved by the regulator.’.
s 14 7 s 16 Electricity Amendment (No. 4) No. 220, 1997 ˙ Amendment of s 169 (Certificate of testing and compliance to be given to customer) 14.(1) Section 169, heading, ‘to be given to customer’— omit. (2) Section 169(1)— omit, insert— ‘ 169.(1) A person who tests and connects electrical installation work or repair work under section 144 must give a certificate about the work in the approved form to the customer as soon as practicable after the connection. Maximum penalty—20 penalty units.’. ˙ Insertion of new pt 2, div 6 15. Part 2, after section 266— insert— ‘Division 6—Exemption from complying with Queensland grid code ˙ ‘ Regulator may exempt from Queensland grid code ‘ 266A.(1) The regulator may exempt a generation entity, a transmission entity, a distribution entity, a retail entity or a holder of a special approval given under part 4 from complying with the Queensland grid code. ‘ (2) The exemption may be given only if the regulator is satisfied that the exemption will not affect— (a) another entity or holder mentioned in subsection (1); or (b) a customer. ‘ (3) The exemption may be given in relation to the whole, or a part, of the code.’. ˙ Amendment of s 267 (Application of this part) 16.(1) Section 267(2)(e), ‘Queensland Transmission and Supply Corporation’—

(2) Section 267(2)— insert— ‘(f) this part does not apply to trade in electricity for the supply of electricity from the Callide A power station to the Queensland Transitional Power Trading Corporation.’. ˙ Insertion of new s 297 17. After section 296— insert— ˙ ‘ Special approval holder providing electricity to customer ‘ 297. For chapter 2, part 2 of the Act, 3 the holder of a special approval authorising the holder to provide electricity to a customer is to be treated as an electricity entity.’. ˙ Amendment of sch 2 (Clearance of overhead electric lines (other than low voltage service lines) 18. Schedule 2, part 4, section 5, heading, ‘assessable’— omit, insert— ‘accessible’. ˙ Amendment of sch 3 (Clearance of low voltage overhead service lines) 19. Schedule 3, after note 2— insert— 3 Chapter 2 (The electricity industry), part 2 (Customers and contestable customers) of the Act
