s1 2 s3 Electricity Amendment (No. 3) No. 436, 1994 ˙ Short title 1. This regulation may be cited as the Electricity Amendment Regulation (No. 3) 1994 . ˙ Regulation amended 2. This regulation amends the Electricity Regulation 1989 . ˙ Insertion of new ss 110A–110C 3. After section 110— insert— ˙ ‘ Commission to make payment ‘ 110A.(1) It is a function of the Commission that the Commission must pay out of its funds to the Consolidated Fund— (a) the dividend for the financial year ended 30 June 1994 of $135 000 000; and (b) the income tax equivalent for the financial year ended 30 June 1994 of $63 100 000; and (c) the dividend for the period 1 July 1994 to 31 December 1994 of $67 500 000; and (d) the income tax equivalent for the period 1 July 1994 to 31 December 1994 of $31 300 000. ‘ (2) The amounts mentioned— (a) in subsection (1)(a) and (b)—must be paid on 12 December 1994; and (b) in subsection (1)(c) and (d)—must be paid on 30 November 1995, unless the Treasurer directs the Commission to make the payment on another day, not earlier than 1 July 1995. ˙ ‘ Electricity board to make payment of dividend ‘ 110B.(1) It is a function of each electricity board mentioned in Schedule 2 that the board must pay out of its funds the dividend stated for

s4 3 s4 Electricity Amendment (No. 3) No. 436, 1994 the board for— (a) the financial year ended 30 June 1994; and (b) the period 1 July 1994 to 31 December 1994. ‘ (2) The amount stated for the electricity board must be paid to the Commission. ‘ (3) The amounts for the period mentioned— (a) in subsection (1)(a)—must be paid on 12 December 1994; and (b) in subsection (1)(b)—must be paid on 30 November 1995, unless the Treasurer directs the board to pay the amount on another day, not earlier than 1 July 1995. ˙ ‘ Electricity board to make payment of income tax equivalent ‘ 110C.(1) It is a function of an electricity board mentioned in Schedule 3 that the board must pay out of its funds the income tax equivalent payment stated in the Schedule for the board for the financial year ended 30 June 1994. ‘ (2) It is a function of an electricity board mentioned in Schedule 3 that the board must pay out of its funds the income tax equivalent payment stated in the Schedule for the board for the period 1 July 1994 to 31 December 1994. ‘ (3) The amount stated for the electricity board must be paid to the Consolidated Fund. ‘ (4) The payment mentioned— (a) in subsection (1)—must be made on 12 December 1994; and (b) in subsection (2)—must be made on 30 November 1995, unless the Treasurer directs the board to make the payment on an earlier day, not earlier than 1 July 1995.’. ˙ Insertion of new Schs 2 and 3 4.
