s1 2 s4 Electricity Amendment Regulation (No. 2) 2001 No. 138, 2001 1 Short title This regulation may be cited as the Electricity Amendment Regulation (No. 2) 2001 . 2 Regulation amended This regulation amends the Electricity Regulation 1994 . 3 Replacement of ch 6, pt 4, hdg Chapter 6, part 4, heading— omit, insert — ‘PART 4—LONG SERVICE LEAVE ‘Division 1—Entitlement ‘Subdivision 1—General entitlement provision’. 4 Amendment of s 309 (Entitlement to long service leave) (1) Section 309— insert— ‘ (2A) This part does not limit another entitlement to long service leave that the employee may have.’. (2) Section 309(3), ‘In subsection (2)’— omit, insert— ‘In this section’. (3) Section 309(2A) and 3— renumber as section 309(3) and (4).
s5 3 s6 Electricity Amendment Regulation (No. 2) 2001 No. 138, 2001 5 Insertion of new ch 6, pt 4, div 1, sdiv 2, hdg After section 309— insert— ‘Subdivision 2—Service and continuity of service’. 6 Insertion of new s 310A After section 310— insert— ‘310A Casual employees ‘ (1) The service of a GOE industry employee with a State electricity entity (the “employer” ) who has been employed more than once by 1 or more State electricity entities over a period is continuous service with the employer even though— (a) the employment is broken; or (b) any of the employment is not full-time employment; or (c) the employee is employed by the entity or entities under 2 or more employment contracts; or (d) the employee would, apart from this section, be taken to be engaged in casual employment; or (e) the employee has engaged in other employment during the period. ‘ (2) However, the continuous service ends if the employment is broken by more than 3 months between the end of 1 employment contract and the start of the next employment contract. ‘ (3) In working out the length of a the employee’s continuous service— (a) service by the employee before 23 June 1990 must not be taken into account; and (b) subject to subsection (2), a period when the employee was not employed by the entity or entities must be taken into account.’.
s7 4 s8 Electricity Amendment Regulation (No. 2) 2001 No. 138, 2001 7 Amendment of s 311 (Calculation of long service leave) (1) Section 311(2)— insert— ‘(c) for a casual employee—the hourly rate for ordinary time payable to the employee— (i) if the employee takes the long service leave—on the day the employee starts the leave; or (ii) if the employee’s employment is terminated—on the day the termination takes effect.’. (2) Section 311— insert— ‘ (3) The minimum amount payable to a casual employee for long service leave is worked out using the formula— - a- -- c- - t- - u- --- a- -- l5- -- s2- - e- -- r- - v- -- i- - c- -- e- × 1- 1- -- 03- × hourly rate where— “actual service” means the total ordinary working hours actually worked by the employee during the employee’s period of continuous service. “hourly rate” means the hourly rate under subsection (2)(c).’. 8 Amendment of s 313 (Periods of absence without pay that count as ‘service’) Section 313— insert— ‘(e) the employee is a casual employee and section 310A applies.’.
s 9 5 s 11 Electricity Amendment Regulation (No. 2) 2001 No. 138, 2001 9 Insertion of new ch 6, pt 4, div 1, sdiv 3, hdg After section 313— insert— ‘Subdivision 3—Calculation of entitlement’. 10 Insertion of new s 313A and ch 6, pt 4, div 2, hdg After section 313— insert— ‘313A Casual employees—conversion to full time equivalent ‘ (1) A State electricity entity may agree with a casual employee that the employees’s entitlement to long service leave may be taken in the form of its full-time equivalent. Example for subsection (1)— If a casual employee— (a) is entitled to be paid for 290 hours long service leave; and (b) works under an award that provides for a full-time working week of 36.25 ordinary working hours; the employee and the employer may agree that the employee takes 8 weeks leave (290 ÷ 36.25 = 8). ‘ (2) This section applies subject to an industrial instrument about the employee’s long service leave. ‘Division 2—Obtaining long service leave’. 11 Relocation and renumbering of ss 311–313 (1) Section 311— relocate and renumber , in subdivision 3, as section 313. (2) Section 312— relocate and renumber , in division 2, as section 315A. (3) Section 313— renumber as section 312.
s 12 6 s 14 Electricity Amendment Regulation (No. 2) 2001 No. 138, 2001 12 Insertion of new ch 6, pt 4, div 3, hdg After section 315— insert— ‘Division 3—Miscellaneous provisions’. 13 Insertion of new s 320A Chapter 6, part 5— insert ‘320A Application of pt 5 ‘This part does not apply for a casual employee.’. 14 Amendment of sch 8 (Dictionary) (1) Schedule 8— insert — ‘ “casual employee” means a GOE industry employee mentioned in section 310A.’. (2) Schedule 8, definition “GOE industry employee” , ‘or part-time’— omit, insert— ‘, part-time or casual’.
