s1 3 s5 Electricity Amendment (No. 2) No. 184, 1994 ˙ Short title 1. This regulation may be cited as the Electricity Amendment Regulation (No. 2) 1994 . ˙ Commencement 2. This regulation commences on 1 July 1994. ˙ Regulation amended 3. This regulation amends the Electricity Regulation 1989 . ˙ Replacement of ss 3–6 4. Sections 3 to 6— omit, insert— ˙ ‘ Fees ‘ 3. The fees payable under the Act are the fees specified in the Schedule. ˙ ‘ Forms ‘ 4.(1) The Commission may approve forms to be used under the Act. ‘ (2) Before approving a form under section 51, 52, 53 or 57, the Commission must have regard to electricity supply industry practice. ‘ (3) A person may ask the Commission to give the person a copy of a document in an approved form. ‘ (4) The Commission must promptly comply with a request under subsection (3).’. ˙ Replacement of s 51 (Notification of intended additions or alterations or of electrical installation work ready for inspection) 5. Section 51— omit, insert—
s5 4 s5 Electricity Amendment (No. 2) No. 184, 1994 ˙ ‘ Informing an Electricity Authority of electrical installation work or the need for a metering change ‘ 51.(1) In this section— “installer” means a person authorised under the Act to perform electrical installation work. ‘ (2) An installer must inform an Electricity Authority of electrical installation work if— (a) the installer performed or supervised the work, or arranged for the work to be performed, for a consumer; and (b) the work must be inspected by an installation inspector before the consumer’s electrical installation is connected to a source of electricity supply. Maximum penalty—8 penalty units. ‘ (3) The installer must inform the Electricity Authority of the work— (a) by giving notice to the Authority in a form approved by the Commission (the “approved form” ); or (b) in a way approved by the Authority (the “approved way” ). ‘ (4) An installation inspector is not required to make an inspection before 2 business days after the Authority is informed of the work under subsection (3). ‘ (5) If an installer informs an Electricity Authority of the work under subsection (3) in the approved way but not in the approved form, the installer must give notice of the work in the approved form to the Authority or an installation inspector before an inspector begins an inspection of the work. Maximum penalty—8 penalty units. ‘ (6) An installer must inform an Electricity Authority of a need for a metering change in the approved form or approved way if— (a) the installer performed or supervised electrical installation work, or arranged for the work to be performed, for a consumer; and (b) the work created a need for a metering change. Maximum penalty—8 penalty units.’.
s6 5 s7 Electricity Amendment (No. 2) No. 184, 1994 ˙ Amendment of s 53 (Electrical contractors and others to test certain work) 6.(1) Section 53(2), ‘Form 2’— omit, insert— ‘the approved form’. (2) Section 53(3),‘in every respect’— omit . (3) Section 53(4)— omit, insert— ‘ (4) An electrical contractor who tests and connects electrical installation work or repair work for a consumer under section 58 must give a certificate for the work to the consumer as soon as practicable after testing and connecting the work. ‘ (4A) The certificate must be in the approved form and certify that the work— (a) has been tested under section 58; and (b) complies with the Act.’. (4) Section 53(5), ‘Form 4A’— omit, insert— ‘the approved form’. (5) Section 53(6), ‘Form 4’— omit, insert— ‘the approved form’. (6) Section 53(7), ‘section 337(5A) of this Act’— omit, insert— ‘section 337C of the Act’. ˙ Replacement of s 59 (Record of inspections, tests, etc.) 7. Section 59—
s7 6 s7 Electricity Amendment (No. 2) No. 184, 1994 omit, insert— ˙ ‘ Keeping records ‘ 59.(1) An Electricity Authority must keep a copy of each inspection report made by its installation inspectors for at least 3 years after the report is made. ‘ (2) An electrical contractor must keep a copy of a certificate given to a consumer under section 53(4) for at least 3 years after the certificate is given to the consumer. Maximum penalty for subsection (2)—8 penalty units. ˙ ‘ Authorised person may inspect records ‘ 59A.(1) The secretary of an Electricity Authority may, by writing, require an electrical contractor to allow a specified person (the “authorised person” ) to inspect records specified by the authorised person. ‘ (2) The authorised person must be an employee of the Authority. ‘ (3) The records the authorised person may specify are the certificate copies mentioned in section 59(2) and must relate to testing and connecting activity performed by the contractor— (a) on days specified by the authorised person, but not more than 31 consecutive days; or (b) at premises specified by the authorised person; or (c) for a consumer specified by the authorised person. ‘ (4) An electrical contractor must comply with a requirement under this section. Maximum penalty—8 penalty units. ˙ ‘ Disconnection of electrical installations ‘ 59B.(1) This section applies if an electrical contractor or an electrical mechanic employed by an electrical contractor (an “electrician” ) performs electrical installation work on a consumer’s— (a) terminal; or
s8 7 s8 Electricity Amendment (No. 2) No. 184, 1994 (b) main switchboard; or (c) mains. ‘ (2) An electrician may de-energise and energise an electrical installation by— (a) removing and replacing a fuse wedge from a service fuse; or (b) switching off and on a circuit breaker installed as a service line disconnector. ‘ (3) The work mentioned in subsection (2) must be done in a way that conforms with recognised electricity supply industry practice. ‘ (4) An electrician may connect the installation to a source of electricity supply only after the work tests satisfactorily under section 58. Maximum penalty—8 penalty units.’. ˙ Replacement of s 62 (Inspection of consumers ’ portable electrical articles at depots) 8. Section 62— omit, insert— ˙ ‘ Inspection of consumers ’ electrical articles ‘ 62.(1) In this section— “trained person” means— (a) an electrical worker; or (b) a person who— (i) has successfully finished a training course approved by the Commission under this section; and (ii) is supervised by an electrical worker. ‘ (2) A consumer who delivers a portable electrical article to an Electricity Authority may ask the Authority to inspect the article. ‘ (3) The Authority must arrange for a trained person to inspect the article as soon as is reasonably practicable after receiving the request. ‘ (4) The Authority must not charge the consumer a fee for the inspection.
s 9 8 s 10 Electricity Amendment (No. 2) No. 184, 1994 ‘ (5) If a trained person finds that the article, if used in the normal way, is likely to cause fire or a person to suffer an electric shock, the trained person must attach a label to the article stating that the article is electrically unsafe. ‘ (6) A person must not take the label off the article or use the article for its designed purpose unless the article is repaired— (a) by an electrical worker; or (b) at an industrial workplace where the primary activity is the making, assembling, altering or adapting of electrical articles. Maximum penalty—8 penalty units.’. ˙ Insertion of new s 78A 9. After section 78— insert— ˙ ‘ Financial and insurance requirements for electrical contractors ‘ 78A. An applicant for an electrical contractor’s licence must produce to the board evidence that the applicant has public liability insurance for at least $1 000 000 and— (a) if the applicant is an individual or partnership— (i) net realisable assets of $5 000; or (ii) a bank guarantee for $5 000; or (b) if the applicant is a corporation— (i) net realisable assets of $10 000 and a guarantee by the directors of the corporation in a form satisfactory to the board; or (ii) a bank guarantee for $10 000.’. ˙ Replacement of s 126A (Public holidays occurring during long service leave) 10. Section 126A— omit, insert—

If an employee is entitled under the employee’s terms of employment to a public holiday and the public holiday happens when the employee is absent on long service leave, a day is added to the employee’s period of leave.’. ˙ Replacement of Schs A and B 11.
