s1 2 s6 Electricity Amendment Regulation (No. 1) 2004 No. 75, 2004 1 Short title This regulation may be cited as the Electricity Amendment Regulation (No. 1) 2004 . 2 Commencement This regulation commences on 1 July 2004. 3 Regulation amended This regulation amends the Electricity Regulation 1994. 4 Insertion of new s 69A After section 69— insert— ‘69A Corporations legislation displacement provision for div 2 ‘This division is declared to be a Corporations legislation displacement provision for the purposes of the Corporations Act, section 5G, in relation to the Corporations Act, chapter 5. 1 ’. 5 Amendment of s 93 (Actual or estimated consumption of more than 0.2 GWh) Section 93, heading, ‘0.2 GWh’— omit, insert— 0.1 GWh ’. 6 Amendment of s 98 (Consideration of application) (1) Section 98(2)(b)— omit, insert— ‘(b) either— 1 Corporations Act, chapter 5 (External administration)
s7 3 s7 Electricity Amendment Regulation (No. 1) 2004 No. 75, 2004 (i) the consumption for the premises during a consumption period was more than 0.1 GWh; or (ii) the estimated consumption for the premises in a future consumption period is more than 0.1 GWh, and— (A) the premises did not consume electricity before the start of the future consumption period; or (B) the premises consumed electricity before the start of the future consumption period, but the premises or the customer’s business or enterprise for which the customer uses the premises was expanded after the start of the future consumption period and the expansion has caused the estimate to be more than 0.1 GWh.’. (2) Section 98(4), definition “consumption period”, from ‘1 July 1996’— omit, insert— ‘the day that is 3 years before the relevant distribution entity receives all necessary information relevant to the application.’. (3) Section 98(4), definition “future consumption period”, ‘, whether beginning before, on or after the commencement,’— omit. 7 Insertion of new ch 3, pt 6, div 1, sdiv 4 Chapter 3, part 6, division 1— insert— ‘Subdivision 4—Actual or estimated consumption of less than 0.2 GWh ‘100A Application of sdiv 4 ‘This subdivision applies to the making of a negotiated customer sale contract for the provision of electricity customer retail services by a retail entity to any single premises of a customer if— (a) the customer has not previously entered into a negotiated customer sale contract with a retail entity; and
s7 4 s7 Electricity Amendment Regulation (No. 1) 2004 No. 75, 2004 (a) within the meaning of section 98(2)(b), 2 the consumption was, or estimated consumption is, for the premises less than 0.2 GWh. ‘100B Definition for sdiv 4 ‘In this subdivision— “cooling-off period” , for the negotiated customer sale contract, means a period of 5 business days starting on the day after the later of the following days— (a) 1 July 2004; (b) the day the contract is made. ‘100C Disclosures to customer (1) The retail entity must, before the customer and the entity enter into the negotiated customer sale contract— (a) give the customer a disclosure statement in the approved form; and (b) ensure the disclosure statement is signed by the customer. (2) The retail entity must keep a copy of each signed disclosure statement until the later of the following days— (a) the day the negotiated customer sale contract ends; (b) the day that is 5 years after the entity and the customer enter into the contract. ‘100D Ending contract during cooling-off period (1) The customer may end the negotiated customer sale contract during the cooling-off period for the contract. (2) The customer ends the contract by giving the retail entity written notice of the ending of the contract. (3) The customer is not liable to the retail entity in any way for ending the contract. (4) The customer can not waive the cooling-off period for the contract.’. 2 Section 98 (Consideration of application)
s 8 5 s 10 Electricity Amendment Regulation (No. 1) 2004 No. 75, 2004 8 Insertion of new s 119A Chapter 4, part 2, division 3— insert— ‘119A Compliance with disclosure requirements (1) This section applies to a retail entity if— (a) the entity proposes to enter into a negotiated customer sale contract with a customer to provide customer retail services to the customer’s premises; and (b) chapter 3, part 6, division 1, subdivision 4, applies to the making of the contract. 3 (2) It is a condition of the retail entity’s retail authority that the entity must, before entering into the contract, comply with the requirements of section 100C. 4 ’. 9 Amendment of s 101 (Contestable customers in Country Energy’s area) Section 101(1)(b), after ‘be’— omit, insert— ‘a retail customer within the meaning of the Electricity Supply Act 1995(NSW).’. 10 Amendment of sch 3 (Special approval holders treated as electricity entities) Schedule 3, item 3, ‘chapter 5, parts 1 and 1C’— omit, insert ‘chapter 5, parts 1, 1B, 1C and 3A’. 3 Chapter 3 (Electricity supply and sale to customers), part 6 (Contestable customers), division 1 (General declarations), subdivision 4 (Actual or estimated consumption of less than 0.2 GWh) 4 Section 100C (Disclosures to customer)
s 11 6 s 11 Electricity Amendment Regulation (No. 1) 2004 No. 75, 2004 11 Amendment of sch 9 (Dictionary) (1) Schedule 9, definition “host retail entity”— omit. (2) Schedule 9— insert— “cooling-off period” , for chapter 3, part 6, division 1, subdivision 4, see section 100B. “host retail entity” , for chapter 3, part 2, division 2, means— (a) generally—the retail entity in whose retail area the premises covered by the contract are located; or (b) for the supply area described in Country Energy’s special approval no. SA21/98—Country Energy.’. (3) Schedule 9, definition “statutory customer sale contract”, after ‘host retail entity’— insert ‘for that division’. ENDNOTES 1.
