s1 2 s4 Electricity Amendment (No. 1) No. 208, 1995 ˙ Short title 1. This regulation may be cited as the Electricity Amendment Regulation (No. 1) 1995 . ˙ Commencement 2. This regulation commences on 1 July 1995. ˙ Regulation amended 3. This regulation amends the Electricity Regulation 1994 . ˙ Replacement of s 271 (Payment for wholesale trade to be based on fixed and variable charges) 4. Section 271— omit, insert— ˙ ‘ Amount payable for electricity bought by wholesale trade ‘ 271.(1) The amount payable under an agreement for electricity bought by wholesale trade must be based on fixed and variable charges. ‘ (2) The fixed charges— (a) are those agreed between the parties to the agreement; and (b) may be worked out according to a formula in the agreement. ‘ (3) The variable charges— (a) for an agreement with a generation entity—must be worked out on a 1 / 2 hourly basis as the average fuel costs of all generating plant, covered by the agreement, that supplies electricity in the 1 / 2 hour; or (b) for any other agreement—are those agreed between the parties to the agreement. ‘ (4) For subsection (3)(a), the average fuel costs must be worked out in dollars per megawatt-hour, on a net (sent-out) basis.’.
