ELECTRICITY ACT 1945—REGULATION

(Relating to the approval of electrical articles)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Electricity Act 1945, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1st April, 1992.

Amendments

2. The Electrical Articles Regulation 1985 is amended:

by omitting from clause 13 (1) (b) the words “3 years” and by
inserting instead the words “5 years”;
by omitting from clause 19 (1) (c) the words “3 years” wherever

occurring and by inserting instead the words “5 years”;

Director-General” and by inserting instead the words “to which
by omitting from clause 25 (1) the words “approved by the
Part 4C of the Act applies”.

EXPLANATORY NOTE

Part 4C of the Electricity Act 1945 provides for the testing of electrical articles to ensure they conform with appropriate safety standards and the granting of approval for their sale if they comply with those standards. Part 4C relates to electrical articles declared by the Governor (by order published in the Gazette) to be articles to which Part 4C applies.

Items 2 (a) and (b)

The object of item 2 (a) is to extend the duration of an approval of an electrical article given under that Act from 3 years to 5 years. Item 2 (b) is consequential on the amendment made by item 2 (a).

Item 2 (c)

It is an offence under the Electricity Act 1945 (section 21A) to sell an electrical article to which Part 4C of the Act applies unless the electrical article is marked as required by the Electrical Articles Regulation 1985. That Regulation provides that electrical articles approved for sale by the Director of the Office of Energy are to be marked accordingly.

The object of item 2 (c) is to require all electrical articles to which Part 4C applies to be labelled, not just those approved by the Director (as at present).
