ELECTRICITY ACT 1945—REGULATION

(Relating to notification of variation of charges etc. for electricity)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Electricity Act 1945, has been pleased to make the Regulation set forth hereunder.

The Electricity Councils Regulation 1987 is amended by inserting after

clause 10 the following clause:

Notification of certain variation of charges etc. not required

10A. An electricity supply authority is not required to notify the Corporation under section 13B of the Act of a variation referred to in that section which is made for the purpose of implementing the recommendations of the Government Pricing Tribunal in its report to the Premier of 6 December 1993 under section 13 (4) of the Government Pricing Tribunal Act 1992.

EXPLANATORY NOTE

Section 13B of the Electricity Act 1945 provides that, except as prescribed, an electricity supply authority must notify the Energy Corporation of a variation in the form and basis of charging for electricity, the method of fixing charges for electricity, the charges for electricity or the terms and conditions of supply of electricity.

1994—No. 30

The object of this Regulation is to remove this requirement where the variation concerned is.made to implement the recommendations of the Government Pricing Tribunal in a recent special report to the Premier. The recommendations relate to a reduction in electricity charges to take effect from 1 February 1994.

This Regulation is made under the Electricity Act 1945, in particular section 13B (Electricity supply authority to notify Corporation of certain matters) and section 37 (the general regulation making power).
