ELECTRICITY ACT 1945—REGULATION
(Relating to higher voltage line work)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Electricity Act 1945, has been pleased to make the Regulation set forth hereunder.

The Overhead Line (Workers) Regulations 1964 are amended:
| (a) | by omitting from clause 6 the definition of “Authority” and by inserting instead the following definition: |
“Corporation” means the Energy Corporation of New South Wales constituted under the Energy Administration Act 1987.
| (b) | by omitting from Regulations 8 (1), (4), 8A (1), 11 (2), 26 (3), 34 (2) and 36 (2) and (3) the word “Authority” wherever occurring and by inserting instead the word “Corporation”. |
| (c) | by inserting after Regulation 5 the following Regulation: Corporation may exempt certain work |
5A. (1) These Regulations do not apply to any person engaged in work that the Corporation, by order published in the Gazette, has exempted from the application of these Regulations.
(2) The Corporation may exempt work:
(a) that utilises a specified experimental technique; or(b) that is undertaken for the purposes of research; or
(c)
that is undertaken for any other purpose approved by the Corporation.

(3) An exemption may be given subject to specified conditions relating to the work. If given subject to conditions, the exemption ceases to have effect in relation to an employer or employee who contravenes the conditions.
EXPLANATORY NOTE
The Overhead Line (Workers) Regulations 1964 regulate employers and employees involved in overhead line work. The object of this Regulation is to allow the Energy Corporation to exempt work utilising new methods or experimental techniques from those Regulations. The Regulation also replaces references to the Energy Authority with references to the Energy Corporation.
