ELECTRICITY ACT 1945—REGULATION
(Relating to electricity distributors exercising water supply functions)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Electricity Act 1945, has been pleased to make
the Regulation set forth hereunder.

The Electricity (Savings, Transitional and Machinery Provisions) Regulation 1993 is amended by inserting after clause 12 the following clause:
Electricity distributors exercising water supply functions
13. (1) In any Act or instrument (other than the Electricity Act 1945 and the Local Government Act 1993 or any instrument made under those Acts), a reference to a council or county council, in relation to the supply of water, is taken to include a reference to an electricity distributor exercising water supply functions because of clause 7 of Schedule 11 to the Electricity Act 1945.
(2) The provisions of the Local Government Act 1993, and the regulations made under that Act, relating to the making and levying of rates and charges apply to an electricity distributor exercising water supply functions because of clause 7 of Schedule 11 to the Electricity Act 1945 in the same way as they apply to a county council exercising water supply functions.

EXPLANATORY NOTE
A proclamation made under the Electricity Act 1945 dissolved a number of county councils with effect from 1 July 1993. The electricity and water supply functions of those defunct county councils were transferred to electricity distributors established under that Act.
The object of this Regulation is to ensure that, as a transitional matter, electricity distributors exercising water supply functions are treated, for the purposes of any Act or instrument (other than the Electricity Act 1945 and the Local Government Act 1993), in the same way as county councils exercising water supply functions.
The Regulation also applies the provisions of the Local Government Act 1993
relating to water rates and charges to those electricity distributors.
This Regulation is made under the Electricity Act 1945, including section 37 (the
general regulation making power) and clauses 1 and 8 of Schedule 11.
