ELECTRICITY ACT 1945—REGULATION

(Prescribing classes of persons as eligible pensioners)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Electricity Act 1945, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 23 January 1995.

Amendment of Electricity (Accounts) Regulation 1994

2. The Electricity (Accounts) Regulation 1994 is amended by inserting

after clause 6 the following clause:

Eligible pensioners

6A. (1) For the purposes of paragraph (a) of the definition of “eligible pensioner” in section 14AA (1) of the Act, the following classes of persons are (subject to subclause (2)) prescribed:

(a) persons who receive a pension, benefit or allowance under Chapter 2 of the Social Security Act 1991 of the Commonwealth, or a service pension under Part III of the Veterans’ Entitlements Act 1986 of the Commonwealth, and who are holders of a pensioner concession card issued by or on behalf of the Commonwealth Government;
(b) persons who receive a pension from the Commonwealth Department of Veterans’ Affairs as:

(i)  the widow or widower of a member of the Australian Defence or Peacekeeping Forces; or

(ii) the unmarried mother of a deceased unmarried member of either of those Forces; or

(iii) the widowed mother of a deceased unmarried member of either of those Forces,

and who do not have income and assets that would prevent them from being granted a pensioner concession card if they were eligible for such a card;

(c) persons who receive a special rate of pension under section 24 of the Veterans’ Entitlements Act 1986 of the Commonwealth.

(2) A person is excluded from a class prescribed by subclause (1) if the dwelling occupied by the person as his or her sole or principal place of living is also occupied by another person as his or her sole or principal place of living, unless that other person is also:

(a) a person of a class prescribed by subclause (1); or

(b)

a person whose income and assets would allow the person to be granted a pensioner concession card if he or she were otherwise eligible for such a card.

EXPLANATORY NOTE

This Regulation prescribes the classes of persons who are “eligible pensioners” for

the purposes of the definition of that term in section 14AA of the Electricity Act 1945.

The Regulation is made under sections 14AA and 37 (the general regulation-making

power) of the Electricity Act 1945.
