ELECTRICITY ACT 1945—ORDER

NEW SOUTH WALES

I, MICHAEL RUEBEN EGAN, Minister for Energy, make the following

Order under section 6FB (3) of the Electricity Act 1945.

Citation

1. This Order may be cited as the Electricity (Transfer of Water Supply

Assets) Order 1996.

Commencement

2. This Order commences on 1 March 1996.

Definition

3. In this Order:

“former distributor” means an electricity distributor constituted

under the Electricity Act 1945;

“new distributor” means an energy distributor constituted under the

Energy Services Corporations Act 1995.

Transfer of staff, assets, rights and liabilities to Energy South

4. (1) The staff, assets, rights and liabilities of the former distributor Energy South, in so far as they relate to its water supply functions under section 6FB of the Electricity Act 1945, are transferred to the new distributor of the same name.

(2) It is a condition sf this Order that the new distributor Energy South

is to maintain separate records in relation to:

(a)

the staff, assets, rights and liabilities of the former distributor’s predecessor Northern* Riverina Electricity, in so far as they relate to the new distributor’s water supply functions under section 61FB of the Act; and

(b)

the staff, assets, rights and liabilities of the former distributor’s predecessor Southern* Riverina Electricity, in so far as they relate to the new distributor’s water supply functions under section 6FB of the Act,

for the purpose of enabling further transfer orders to be made in relation

to them under that section.

Transfer of staff, assets, rights and liabilities to NorthPower Energy
5. (1) The staff, assets, rights and liabilities of the former distributor
NorthPower Energy, in so far as they relate to its water supply functions

under section 6FB of the Electricity Act 1945, are transferred to the new

distributor of the same name.

(2) It is a condition of this Order that the new distributor NorthPower Energy is to maintain separate records in relation to the staff, assets, rights and liabilities of the former* distributor’s predecessor NorthPower, in so far as they relate to the new distributor’s water su ply functions under section 6FB of the Act, for the purpose of enabling fu urther transfer orders to be made in relation to them under that section.
