ELECTRICITY ACT 1945—ORDER
NEW SOUTH WALES

I, Michael Rueben Egan, Minister for Energy, make the following Order in pursuance of section 6A (2) and 6B (5) of the Electricity Act 1945.

Citation
1. This Order may be cited as the Electricity (Amalgamation of
Electricity Distributors) Order 1995.
Commencement
2. This Order commences on 1 October 1995.
Definition
3. In this Order, “the Act” means the Electricity Act 1945.
Transfer of staff, assets, rights and liabilities to Energy South
4. (1) The staff, assets, rights and liabilities of the following electricity
distributors are transferred to Energy South:
(a) Monaro Electricity;
(b) Murrumbidgee Electricity;
(c) Northern Riverina Electricity;
(d) South West Slopes Electricity;
(e) Southern Riverina Electricity;
(f) Southern Tablelands Electricity;
(g) Tumut River Electricity.

(2) The following assets of Murray River Electricity are transferred to
Energy South:
(a) any interests held by Murray River Electricity in land situated within Energy South’s distribution district; (b) any immoveable assets held by Murray River Electricity in the form of power lines, electrical structures or electrical equipment on land situated within Energy South’s distribution district.
(3) The following assets of Illawarra Electricity are transferred to Energy South:
(a) any interests held by Illawarra Electricity in land situated within Energy South’s distribution district; (b) any immoveable assets held by Illawarra Electricity in the form of power lines, electrical structures or electrical equipment on land situated within Energy South’s distribution district.
(4) It is a condition of this Order that Energy South is to maintain separate records in relation to:
(a)
the staff, assets, rights and liabilities of Northern Riverina Electricity, in so far as they relate to its water supply functions under section 6FB of the Act; and
(b)
the staff, assets, rights and liabilities of Southern Riverina Electricity, in so far as they relate to its water supply functions under section 6FB of the Act,
for the purpose of enabling transfer orders to be made in relation to them
under that section.
Transfer of staff, assets, rights and liabilities to Far West Energy
5. (1) The staff, assets, rights and liabilities of Broken Hill Electricity are transferred to Far West Energy.
(2) The following assets of Murray River Electricity are transferred to Far West Energy:
(a) any interests held by Murray River Electricity in land situated within Far West Energy’s distribution district; (b) any immoveable assets held by Murray River Electricity in the form of power lines, electrical structures or electrical equipment on land situated within Far West Energy’s distribution district.

Transfer of staff, assets, rights and liabilities to MetNorth Energy
6. The following assets of Shortland Electricity are transferred to
MetNorth Energy:
(a)
any interests held by Shortland Electricity in land situated within MetNorth Energy’s distribution district;
(b)
any immoveable assets held by Shortland Electricity in the form of power lines, electrical structures or electrical equipment on land situated within MetNorth Energy’s distribution district.
Transfer of staff, assets, rights and liabilities to MetSouth Energy
7. (1) The following assets of Illawarra Electricity are transferred to
MetSouth Energy:
(a)
any interests held by Illawarra Electricity in land situated within MetSouth Energy’s distribution district;
(b)
any immoveable assets held by Illawarra Electricity in the form of power lines, electrical structures or electrical equipment on land situated within MetSouth Energy’s distribution district.
(2) The following assets of Prospect Electricity are transferred to
MetSouth Energy:
(a)
any interests held by Prospect Electricity in land situated within MetSouth Energy’s distribution district;
(b)
any immoveable assets held by Prospect Electricity in the form of power lines, electrical structures or electrical equipment on land situated within MetSouth Energy’s distribution district.
Transfer of staff, assets, rights and liabilities to MidState Energy
8. (1) The staff, assets, rights and liabilities of the following electricity
distributors are transferred to MidState Energy:
(a) Central West Electricity;
(b) Ophir Electricity;
(c) Southern Mitchell Electricity;
(d) Ulan Electricity;
(e) Western Power.

(2) The following assets of Prospect Electricity are transferred to MidState Energy:
| (a) | any interests held by Prospect Electricity in land situated within MidState Energy’s distribution district; |
| (b) | any immoveable assets held by Prospect Electricity in the form of power lines, electrical structures or electrical equipment on land situated within MidState Energy’s distribution district. |
Transfer of staff, assets, rights and liabilities to NorthPower Energy
9. (1) The staff, assets, rights and liabilities of the following electricity distributors are transferred to NorthPower Energy:
(a) Namoi Valley Electricity;
(b) New England Electricity;
(c) North West Electricity;
(d) Northern Rivers Electricity;
(e) NorthPower;
(f) P-CCC Electricity.
(2) The following assets of Shortland Electricity are transferred to NorthPower Energy:
| (a) | any interests held by Shortland Electricity in land situated within NorthPower Energy’s distribution district; |
| (b) | any immoveable assets held by Shortland Electricity in the form of power lines, electrical structures or electrical equipment on land situated within NorthPower Energy’s distribution district. |
(3) Any immoveable assets held by Tenterfield Council in the form of power lines, electrical structures or electrical equipment are transferred to NorthPower Energy.
(4) It is a condition of this Order that NorthPower Energy is to maintain separate records in relation to the staff, assets, rights and liabilities of NorthPower, in so far as they relate to its water supply functions under section 6FB of the Act, for the purpose of enabling transfer orders to be made in relation to them under that section.
