267 (Queenshindt ANNO TERTIO DECIMO ELIZABETHAE SECUNDAE REGINAE No. 28 of 1964 An Act to Amend "The Electrical Workers and Contractors Act of 1962" in certain particulars [ASSENTED TO 14TH APRIL, 1964] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. (1) Short title . This Act may be cited as " The Electrical Workers and Contractors Act Amendment Act of 1964." (2) Principal Act. " The Electrical Workers and Contractors Act of 1962" is in this Act referred to as the Principal Act. (3) Collective title. The Principal Act and this Act may he collectively cited as " The Electrical Workers and Contractors Acts, 1962 to 1964."

Section three of the Principal Act is amended by omitting the words, numerals and symbols " PART IV.-GENERAL (ss. 24-33) " and inserting in their stead the words, numerals and symbols- ) " PART IV.--INSTALLATION P ERFMFTS (ss. 23A- 23c "; " PART V.- GENERAL (ss. 24--33)." 3. Amendments of s. 6 . Section six of the Principal Act is amended by- (a) in the definition " Electrical fitter "- (i) omitting paragraph (a) and inserting in its stead the following paragraph:- "(a) person who supervises or engages in actual trade work, whether in a workshop or on site, of constructing, manufacturing, fitting, assembling, erecting, operating or repairing electrical machines and apparatus;"; (ii) omitting paragraph (b); (iii) relettering paragraph (c) as paragraph (b); (iv) relettering paragraph (d) as paragraph (c); (b) in the definition " Electrical mechanic " inserting after the word " maintaining " the symbol and word ", repairing "; (c) in the definition " Electrician " omitting the word, brackets and letter " or (b) "; (d) inserting after the definition " Inspector "-the following definition- as Installation permit "-An installation permit issued and held pursuant to Part IV. of this Act." (e) omitting the definition " Minister " and inserting in its stead the following definition:- Minister "-The Minister for Industrial Development or other Minister of the Crown for the time being charged with the administration of this Act;". 4. Amendments of s. 19 . Section nineteen of the Principal Act is amended by- (a) in subsection (2) inserting after the words " twelve months " appearing in paragraph (c) the words " or for such lesser period as the Board deems satisfactory for the purposes of this section "; (b) in subsection (4) inserting after the words " twelve months " appearing in the first paragraph the words " or for such lesser period as the Board deems satisfactory for the purposes of this section "; (c) in subsection (5) inserting after the words " twelve months " appearing in the first paragraph the words " or for such lesser period as the Board deems satisfactory for the purposes of this section ". 5. Amendments of s. 21 (3). Subsection (3) of section twenty-one of the Principal Act is amended by- (a) inserting after paragraph (c) of the first paragraph the following subparagraph :- " (d) from employing any person to carry out in the capacity of his servant, any electrical installation work for any purpose of or connected with adding to or altering or repairing any electrical installation where that firstmentioned person holds an installation permit in respect of the electrical installation
Electrical Workers and Contractors Act Amendment Act of 1964, No. 28 269 specified in that permit and the person so employed held during the period of such employment a certificate of competency either as an electrical mechanic or as an electrician; " and '(b) adding the following paragraph- " The provisions of this section shall not apply with respect to a private plant which is not connected to any electricity supply main or service line of any electric authority or in respect of which " The Electric Light and Power Acts, 1896 to 1962," do not apply." 6. Amendment of s. 22 (1). Subsection (1) of section twenty-two of the Principal Act is amended by, in paragraph (c), inserting after the words " that such holder " the words " has failed or refused to submit a ready for test notice or has failed or refused to pay a re-test fee or ". 7. Part IV. and new ss. 23A, 23B and 23C inserted . The Principal Act is amended by inserting after section twenty-three the following headnote and sections- " PART IV.-INSTALLATION PERMITS " " [23A.] Issue of Installation Permits . (1) Upon application made on the form prescribed by a person (which term includes any corporation, partnership, society or association) who satisfies the Board-- (a) that for the carrying on of the business or activities of such person he employs in respect of an electrical installation one or more persons, who or each of whom hold under this Act a certificate of competency as an electrical mechanic or electrician, to carry out in the capacity of an employee or employees, as the case may be, any electrical installation work for any purpose of or connected with adding to, altering or repairing such electrical installation; (b) of the situation of the electrical installation; (c) of such other matters as may be prescribed, and who pays the prescribed fee the Board shall issue to the person making the application in the name of such person an installation permit. (2) An installation permit shall authorise the holder thereof to employ persons holding certificates of competency either as electrical mechanics or electricians in respect of the electrical installation therein specified. [23B.] Duration and renewal of permit . (1) Subject to this Act, an installation permit shall be in force on and from the date of the granting thereof and thereafter to and including the next following thirtieth day of June, and may be renewed by the Board from time to time upon application in that behalf and on payment of the prescribed fee. (2) Subject to this Act, every renewal of an installation permit shall be in force for twelve months from and including the date of renewal. For the purposes of this subsection, the day immediately following the day on which the permit or the next previous renewal thereof expired shall, subject to subsection (3), be deemed to be the date of any renewal in question of any installation permit. (3) Where an installation permit is renewed subsequent to the date of the expiry of the installation permit or next previous renewal thereof, as the case may be, the renewal shall come into force on such subsequent date but shall expire on the date on which it would have expired had it been renewed on or before the date of expiry of the permit or next previous renewal, as the case may be.

(I) The Board shall cause to be made and kept a register, to be called the " ° Register of Installation Permits, Queensland," of all installation permits granted by it under this Part. Such register shall be on the loose-leaf or card- index system. (2) The Board shall cause to be entered in such register- (a) the full name and address of every person holding an installation permit under this Part; (b) the date of granting of the installation permit and of every renewal thereof; (c) such other particulars as may be prescribed. (3) If any holder of an installation permit fails to renew such installation permit within the prescribed time the board shall thereupon cause his name to be erased from such register. (4) If the permit is later duly renewed, the Board shall cause the name of the holder thereof to be restored to the register. (5) The Board shall cause a list of the names and addresses of the persons holding installation permits under this Part to be published in the Industrial Gazette once at least in each year and so that the period between succeeding such publications shall not exceed thirteen months. (6) In respect of the period on and from the date of the publication of any such list and thereafter up to the date of the publication of the next following such list, a copy of the Industrial Gazette containing any such list shall be prima facie evidence in any proceedings that at any material time- (a) any person named in such list holds an installation permit under this Act; or (b) any person not named in such list does not hold an installation permit under this Act." 8. New headnote inserted . The Principal Act is amended by omitting before section twenty-four the headnote " PART IV.-GENERAL " and inserting in its stead the headnote " PART V.-GENERAL ". 9. Amendment of s. 25 (1). Subsection (1) of section twenty-five of the Principal Act is amended by inserting after the word " license " wheresoever that word appears in that subsection the words " or installation permit ". 10. Amendment of s. 28 (2). Subsection (2) of section twenty-eight of the Principal Act is amended by- (a) inserting after the word " Queensland," the words " and The Register of Installation Permits, Queensland "; (b) omitting the words " a book " and inserting in their stead the word "books "; (c) omitting the word " its ". 11. Amendment of s. 30 (1). Subsection (1) of section thirty of the Principal Act is amended by omitting in paragraph (b) the words " and licenses " and inserting in their stead the symbol and words ", licenses and installation permits ".

The Schedule to the Principal Act is amended by- (a) in clause nine inserting after the words " chartered electrical engineer " the words " or an electrical contractor "; (b) in clause eleven adding to sub-clause (4) the following paragraph:- "An applicant for a certificate of competency as an electrical linesman or electrical mechanic or electrician shall produce satisfactory evidence that he is competent to render resuscitation at the pole-top as well as on the ground." 13. Power to make regulation forty under Principal Act. It is hereby declared that the power to make regulations under the Principal Act always included power to make the regulation numbered forty in the regulations made under that Act and published in the Industrial Gazette on the twenty-second day of December one thousand nine hundred and sixty-two and the seventh day of September one thousand nine hundred and sixty-three.
