This Act applies only to pei'sons engaged in and about electrical work in connection with the installation and repair of generator,:; and the transmission and supply of electrical energy. This Act does not apply to any electrical work for the purposes of the Postmaster-General of the Commonwealth. Nothing in this Act contained shall be construed to prejudice, prevent, or a£Ioot- (a) Any mechanical engineer in or from taking charge of any machinery, provided that he is not employed mainly on electrical work; (b) Any mechanic in or from making any necessary repairs to any electrical appliance or plant,. provided that he is not employed mainly on electrical work; (c) Any owner of an electrical generator or motor used in connection with any business carried on by him in or from working the same or making or causing to be made any necessary repairs thereto by himself ; (d) Any mechanical engineer from engaging in the manufacture of apparatus from raw material for use in connection with electrical work and when such apparatus is not connected to the source of supply. Nothing in this Act contained shall be construed to prevent any electrical engineer, being a corporate member of the Institute of Electrical Engineers, London, from practising his profession : Provided th~ if any such person does in fact act with respect to any electrical work in the capacity of an electrical worker, he shall for the purposes of this Act be deemed to be an electrical worker, and for any fault or .defect in the work for which he is responsible the Board may either suspend him for such period as it thinks fit or disqualify him permanently from acting in such capacity,. and while he is so suspended or disqualified it shall not be lawful for him to do the work of an electrical worker. The term shall include a person engaged in the erecting and connecting up of dynamos, motors, and switchboards, and the connecting up of all instruments and apparatus at the point of utilisation and supply for all purposes, including power, lighting, heating and smelting, and safe working instruments, * 60 Vie. This Act. apparatus, telephones, bells, meter fixing, connecting of meters, and the erection, overhauling, and repairing of storage batteries, and the assemhling and renewing of finished parts, and marking out and mounting of any switchboards, and the effecting of any repairs to electrical machines and appliances when it is necessary to carry out the work on the spot or is incidental to such necessary work; "Electrical work"-All work done in connection with the installation and repair of electric lines, meters, accumulators, fittings, and apparatus for the generation, transmission, and/or supply of electrical energy; "Electrical workers"-All persons engaged on electrical work, including electrical fitters, electrical mechanics, electrical linesmen, and eleetrieal jointers; " ImproveI' "-An electrical worker who by direction of the Board of Trade and Arbitration given in his case is serving at a special wage a period of training with an employer for the purpose of becoming a qualified electrical worker; "Industrial ArbitrationAct "-*" The Industrial Arb~ ~ tration Acts, 1916 to 1926," and any Act amending or in substitution for those Acts; "Industrial inspector"-An industrial inspector appointed under the Industrial Arbitration Act; "Minister"-The Secretary for Labour and In- dustry, or other Minister of the Crown for the time being charged with the administra- tion of this Act ; "Person" includes any firm, company, associa- tion, group of persons, or corporation; "Prescribed "-Prescribed by this Act; " Regulations"-Regulations made under the authority'of this Act ; " This Act "-This Act and any Orders in Council or regulations made thereunder. * 7 Geo. For the purposes of this Act there shall be an Creati<.m of Electrical Workers Board, consisting of nine members ~~~r~~:l to be appointed by the Governor in Council, namely- Board. Two representatives of the Government nominated by the Minister; A representative, who shall be a qualified engineer or the holder of a certificate under this Act, elected by the electric authorities in the State; A representative nominated by the Fire Under- writers' Association of Queensland; A representative, who shall be a qualified engineer or the holder of a certificate under this Act, elected by the employers in the electrical industry in the State; Two representatives, who shall each be the holder of a certificate, elected by the certificated employees in the electrical industry in the State; Two representatives, who shall each be the holder of a certificate under this Act, nominated by the Queensland Branch of the Electrical Trades Union of Australia. (2.) One of the representatives of the Government Cha;rman. shall be the chairman of the Board. In the event of the absence of a representative of the Government from any meeting of the Board, some other person to be appointed by the Minister for the purpose may attend and shall for the purpose of that meeting be deemed to be a member of the Board. (3.) Subject to this Act, the Board shall meet at BUsinC3S. such times and conduct their business in such manner as they may decide or as may be prescribed by the regulations. (4.) The Minister, the Queensland branch of the Representa- Electrical Trades Union of Australia, and the certificated tiie~ . employees in the electrical industry in the State may change their representativE's from time to time; the electric authorities in the State, the Fire UndenYTiters' Association of Queensland, and the employers in the electrical industry in the State may each change their representative from time to time. Every such appointment or change shall be notified in the Gazette.

In the absence of any representative other than the represent,atives of the GoYernment, the authority appointing him may, in writing, appoint a proxy, with similar qualification, with power to act and vote for such absent representative at any meeting or meetings of the Board as may be required. The Bmud shall have power to grant- (a) Certificates of competency to all candidates ,vho mtisfy them that they possess the neces- sary practical and theoretical knowledge, skill, and intelligence, and who are not otherwise unfit; (b) Certificates of service without examination in accordance with the conditions hereinafter prescribed; Provided that a certificate of service shall have the same effect and confer the same status for all the purposes of this Act as a certificate of competency. (2.) Any person holding a certificate granted by the Board of Electrical Examiners under the powers con- ferred upon such Board by regulations under t"The Electn'c Light arid Power Act, 1896," and subsisting at the date of the commencement of this Act, shall be entitled to apply for and be granted as of right a like {;crtificate under this Act. (3.) The said Board of Electrical Examiners is hereby abolished. ~ ules in the (4.) (1.) On receiving such a report as aforesaid, the Board may, after due inquiry being made therein-- (a) If the person in respect of whose work the report is made is a certificated electrical worker, either cause his certificate to be' suspended or cancelled; or (b) If he is the holder of an interim certificate (hereinafter referred to), withdraw such certificate. Board is satisfied that such inspection has been or is ~ ; rt~ ! ~ ~ ~ being made in an unfair or unsatisfactory manner, the Board may recommend to the authority appointing such inspector the cancellation of such appointment, or may recommend that he be suspended for such period as it thinks fit. 14. Every person who is an applicant for a certificate Applicant of s~ rvice under this. Ac~ , and every person who is an : afu: f! ~ : : : . applicant for an exammatlOn pursuant to rule twelve of the Schedule to this Act, who is dissatisfied with the decision of the Board in his case, may, within three months after notice of such decision has been communicated to him by the secretary, appeal to the Minister, and the Minister may, after hearing such person and. the Board, dismiss the appeal or order the Board to permit such applicant to sit for an examination for a certificate of competency, as the case may require. 15. (1.) Any person who obtains or attempts to Obt~ ining obtain any certificate by fraud or fraudulent means shall ; : ; ~ ~ ~ : ; ~ Y. be liable to a penalty not exceeding twenty pounds. &c. Every certificate improperly obtained, whether obtained before or after the commencement of the Act, may be cancelled by the Board; and the holder thereof shall, when called upon by the Board, return such certificate. Every person who uses any such certificate after notice by the Board that the same has been cancelled shall be liable to a penalty not exceeding twenty pounds. (2.) Every person who- False entries, (i.) Makes in any prescribed book, register, notice, &c•. certificate, or document an entry which in any material particular is to his knowledge false; or (ii.) Makes use of any entry or certificate which in any material particular is to his knowledge false, shall be liable to a penalty not exceeding twenty pounds or to be imprisoned for any period not exceeding three months. Any person who- (a) Not being the holder of a certificate of the appropriate description, or not being an inspector of electrical works under this Act, uses or causes to be used in connection with his business, trade, or calling any written words, titles, initials, or abbreviation of words, titles, or initials intended to cause, or \vhich may reasonably cause, any other person to believe or that may be construed to imply that he is the holder of such certificate or is otherwise registered; or (b) Does, or employs or permits any person to do, any electrical \vork contrary to the provisions of this Act, shall be guilty of an offence against this Act and liable to a penalty not exceeding twenty pounds. (2.) Any person who fails or refuses to surrender to the Board, on demand in writing, his certificate as an electrical worker issued to him under this Act, shall be guilty of an offence against this Act and liable to a penalty not exceeding five pounds. (3.) Any person who hinders or obstructs any inspector in the exercise of his powers under this Act shall be liable to a penalty not exceeding twenty pounds. 17. (1.) In any proceeding under this Act- (a) It shall not be necessary to prove the appointment or election of the members, chairman, or secretary of the Board; (b) It shall not be necessary to prove the appointment of any inspector or officer or the authority of any inspector or officer to do any act or give any direction or take any proceeding, and the averment of any such thing as aforesaid where necessary in any complaint shall be sufficient evidence of the fact until the contrary is proved. (2.) A writing certified by the secretary to be a true copy of or a true extract from any register, book,. certificate, notice, list, declarat:on, statement, document, or writing of any nature whatsoever in thecust6dy of the Board or of any officer of the Board, shall for all {

11906 ELECTRICITY. Electrical Workers Act. 18 GEO. V. Xo. 19, Fees. Generally. (vi.) Scales of fees to be paid for the examination for and granting of certificates of competency; (vii.) Generally for carrying this Act into effect. The regulations may provide a penalty not exceeding twenty pounds for any breach thereof. All such regulations shall, upon being published in the Gazette, be of the same effect as if they were enacted in this Act, and shall be judicially noticed, and shall not be questioned in any proceedings whatsoever. All such regulations shall be laid before Parliament within fourteen days after the publication thereof, if Parliament is then sitting, or if not, then within fourteen days after the commencement of the next session thereof. If the Legislative Assembly passes a resolution disallowing any such regulation, of which resolution notice has been given at any time within fourteen sitting days of such House after such regulation has been laid before it, such regulation shall thereupon cease to have effect, but without prejudice to the validity of anything done in the me~ntime. For the purpose of this section, the term "sitting days" shall mean days on which the House actually sits for the despatch of business. SCHEDULE. Votes at eleetionR. 1. (l.) In t.he case of t.he election of t.he representatives of the electric aut.horities and the employers in the electrical industry respectively, each authority and each employer shall have one vote only. (2.) In the case of the election of the representatives of the employees in the electrical indust.ry, only celtificated electrical workers (whether then actually employed or not) shall have a vote, and each such worker shall have one vote only. The duties of the Board shall be- (a) To co-operate with the Department of Public Instruction in preparing the syllabus of work for candidates for certificates of competency, and to advise from time to time as to the courses of instruct.ion for candidat.es for certificates of compet.ency; (b) To conduct examinations for cert.ificates of competency and to isslle certificatfs of cem fetency and certificates of service; (c) To make such public notification as to the granting and cancellation of certificates as the Minister may direct; (d) To carry out such other duties as may be prescribed or as the Minister may from time to time require.
ELECTRICITY. 11901 1927. Electrical Workers Act. 3. The chairman shall act as the executive officer of the Board. Chairman. 4. The Board with the approval of the Minister shall appoint a Secretary. :£ecretary. The secretary shall keep minutes of meetings of the Board, issue notices of meetings, conduct correspondence, keep records of examina,tions and of the issue, cancellation, and suspension o()f certificates, and perform such other duties pertaining to the business of the Board as the"Board may direct. 5. (1.) A meeting of the Board shall be held at least once in Meetings of every eight weeks. Board. (2.) Notice of the time and place of meeting, and of the business to be transacted by the Board thereat, shall be given to all members .at least seven days before the date of the meeting. (3.) The chairman shall preside at every meeting at which he is ·present. (4.) The business transacted at any meeting shall be th'lt ,specified in the notice. (5.) Any five members of the Board shall form a quorum. (6.) A speciaJ meeting for any particular purpose may be called by the chairman at his discretion or when he is requested by two members to call such a meeting. If the chairman fails to call a special meeting after such a crequest, any three members of the Board may call such meeting by a notice signed by themselves. Such notice shall state the time and place of mf,leting and the business to be transacted thereat, and shall be given to members at least seven days before the date of such meeting. The husiness transacted at any special meeting shall be that :specified in the notice. (7.) At any meeting of the Board, if a quorum is not present within fifteen minutes after the notified hour of meeting, that fact .and the names of the members present shall be recorded by the :secretary in the minute-book. (8.)' All powers vested in the Board may be exercised by a majority of the members present at any meeting duly held, and all questions shall be decided by a majority and by open voting. Upon every question the chairman shall have a vote, and if the numbers are equally divided he shall have a second or casting vote. If any member refuses to vote, his vote shall be counted for the negative. (9.) The order of business at any meeting shall be- (a) Reading of minutes; (b) Reading of correspondence; (c) Consideration of application for examination; (d) Oonsideration of certificates; (e) Sub-committee reports; (f) Other business.

No proceedings of the Board or of any person acting as chairman or member shall be invalidated by reason of any defect in his appointment or election or nomination or of any disqualification of any such person, or by reason of there being any vacancy in the- number of members at the time of such proceedings. Examiners_ Times of examina- tions. 7. The Board may appoint examiners to conduct the examination of candidates for certificates of competency. 8. Examination for certificates of competency shall be held at such times and places as the Board thinks fit. Notification of the time and place of holding such examinations shall, at least one month before the date of holding of the examina- tions, be published in a daily newspaper circulating in the locality in which the examination is to be held. ~ ~ ~ fn~ ~ ! tio 9. In determining the scope of the examination for certificates of n. competency as electrical workers, the definitions of "electrical fitter," "electrical mechanic," "electrical linesman," and" electrical jointer," respectively, contained in this Act, shall be taken into consideration in so far as such definitions delimit the work of such electrical workers respectively; and such scope may include tests in calculation, practical work, sketching, and knowledge of the electric wiring rules. of the Institution of Engineers, Australia. Electrical fitter. 12. (1.) Any person may apply for examination for a certificate- of competency as an electrical fitter who- (i.) (a) Has served as an apprentice to the electrical trade for such period as is prescribed by the industrial award made- under the Industrial Arbitration Act, and has conformed to the provisions of *" The Apprenticeship Act of 1924," and (b) Produces a certificate from his employer stating that his. conduct is satisfactory, and outlining the amount of experience he has had as an electrical fitter or as a mechanical engineer or fitter; or (iL) (a) Is not an apprentice within the meaning of *"The: Apprenticeship Act of 1924," and (b) Produces evidence that he had worked as a junior or improver for a period of at least five years under the- direction of a recognised electrical employer or journeyman electrical worker, or that for a period of not less than three years prior to the commencement of this Act he had been employed as a journeyman elect,rical fitter; or * 15 Geo. Any person may apply for examination for a certificate of competency as an electrical jointer, who-- (i.) (a) Is not an apprentice within the meaning of *" The Apprenticeship Act of 1924," and (b) Produces evidence that he had worked as a junior or improver for a period of at least five years under the direction of a recognised electrical employer or journeyman electrical worker, or that for a period of not lcss than three years prior to the commencement of this Act he has been employed as a journeyman electrical jointer; or (c) In the case of a person entering this State from outside this State, produces evidence that he has worked as a junior or improver for a period of at least five years under the direction of a recognised electrical employer or journeyman electrical worker, or that for a period of not less than three years be has been employed as a journeyman electrical jointer; or (d) Has been employed as an assistant in electrical jointing work for a period of at least three years; or (e) Has been employed as a cable jointer in the employ of the Postmaster-General's Department; and in each of such cases (b) (c) (d) and (e)- (f) Produces a certificate from his last electrical employer that his conduct and work as an electrical worker has been satisfactory, and (g) . Produces a statement outlining the amount of experience he has had in the trade of an electrical jointer. (4.) Any person may apply for examination for a certificate of competency as an electrical linesman, who- (a) Has been employed on electrical line construction or repairing work for at least two years; or (b) Has had one year's experience as linesman in the employ of the Postmaster-General's Department and has also been employed on electrical line construction or repairing work for a period of at least one year; and in each of such caRes (a) and (b)- (c) Produces a certificate from his employer stating that his conduct is satisfactory, and outlining the amount of experience he has had in the electrical industry. *15 Geo. Certificates of service may be granted by the Board to all Cert~ ficate of persons entering this State from outside this State who are at the se;vlCe d9te of the commencement of this Act engaged in the electrical :~ ~ ~~ ation industry and who can satisfy the Board that they are competent' .. and that they have served a term of at least five years either as apprentices or improvers or juniors under the direction of an employer or journeyman, and who in addition have been employed as electrical fitters or electrical jointers or electrical linesmen or electrical mechanics for at least one year as journeymen. Notwithstanding anything herein contained to the con- Gen~ ral trarv, a general certificate of competency may in the discretion of certlfh'lute of the Board be granted to an electrical fitter or an electrical mechanic competency. on application being made by such electrical fitter or electrical mechanic in that behalf, whereby such certificate may embrace and include the work of an electrical fitter, electrical mechanic, electrical jointer, and electrical linesman, and permit of such electrical fitter or electrical mechanic performing all or any of such work appertaining thereto, in any case in which the Board is satisfied that such electrical fitter or electrical mechanic is competent to so perform such work and where it is considered necessary in the public interest that such certificate of competency should be issued to such electrical fitter or electrical mechanic.

Such certificate of competency may be issued for a term not exceeding six months, but may in the discretion of the Board be renewed for any like period or periods : Provided that in the event of the Board refusing to issue such certificate as aforesaid, the applicant may appeal to the Minister, and the Minister may, after hearing such applicant and the Board, dismiss the appeal or order the Board to issue such certificate of competency subject to any terms and conditions as he may deem fit and proper to make. Cancellation 17. If it is considered that a certificated electrical worker has o~ sus~ ~ nsion been guilty of gross misconduct or negligence as a tradesman, the o cert! rate. Board may call on him to show cause why his certificate should not be cancelled or suspended; and after inquiry the Board may cancel or suspend such certificate. Dietation test. 18. Subject to the regulations, no person who has not first· obtained from the Board in the prescribed manner a certificate that he is able to read and write from diqtation words in the English language of not less than fifty words shall be entitled to apply for or hold a certificate of competency or service under this Act. The regulations may make provision- (i.) For the examination and granting of certificates or ability to read and write from dictation words in the English language; (ii.) For the exemption from the operation of this section of this Schedule of any persons or classes of persons whom for any reason it is not considered necessary to examine. Duplicate 19. If any certificate is lost or destroyed, the holder, or some certificate in person having knowledge of the facts and circumstances, may make rase of loss. a statutory declaration with respect thereto; and the Board, if satisfied with such declaration, may issue a fresh certificate to the person entitled to hold the same, on payment of the prescribed fee. Such certificate shall be endorsed with a memorandum setting out the reasons for the issue thereof; and thereafter such certificate shall be available as if it were the original certificate. Fees. 20. (l.) In connection with the holding of examinations and the issue of certificates, the following fees shall be the fees payable : - £ s. cl. (a) For application to sit for examination 050 (b) For certificate of competency after successful examination 110 (c) For certificate of service without examination 0 10 6 (cl) For reissue of any certificate after suspension 0 10 6 (e) For issue of any fresh certificate on loss or destruction of original 0 5 () Provided that the amount of the fee specified in (a) above shall accompany the candidate's application for examination, and that the fee specified in (b) or (c) or (cl) or (e\ above shall be forwarded prior to the is<;ue or reissue of the certificate.
