s1 2 s6 Electrical Safety Amendment Regulation (No. 3) 2005 No. 141, 2005 1 Short title This regulation may be cited as the Electrical Safety Amendment Regulation (No. 3) 2005 . 2 Commencement This regulation commences on 1 July 2005. 3 Regulation amended This regulation amends the Electrical Safety Regulation 2002. 4 Amendment of s 12 (Requirements for performance of live work) Section 12(2), definition safety observer — omit, insert — ‘ safety observer means a person who— (a) observes the performance of electrical work; and (b) is competent to help a person performing the electrical work; and (c) has been assessed in the last 6 months to be competent to rescue a person performing electrical work and provide resuscitation.’. 5 Amendment of s 24 (Misrepresentations about electrical equipment or work) Section 24(2), penalty, ‘for subsection (2)’— omit. 6 Amendment of s 24A (Misrepresentations about lawful authority to contract for the performance of electrical work) Section 24A— insert—

Maximum penalty—40 penalty units.’. 7 Amendment of s 52 (Register of electrical licences) Section 52(4), ‘written’— omit. 8 Amendment of s 103A (Extension of term of approval by up to 1 year) Section 103A— insert— ‘(8) If the approval will expire before the 28 days have passed, the term of the approval is extended until the chief executive gives the notice mentioned in subsection (6).’. 9 Amendment of s 103B (Renewal of approval) Section 103B— insert— ‘(9) If the approval will expire before the 28 days have passed, the term of the approval is extended until the chief executive gives the notice mentioned in subsection (7).’. 10 Amendment of s 168 (Refund of part of fee) Section 168(2), definition appointment administration part— omit, insert— ‘ appointment administration part , of a fixed fee, means the amount stated in schedule 7 as the cost of administering an appointment as an accredited auditor.’. 11 Amendment of s 204 (Definitions for div 1) Section 204, definition total contribution amount, ‘ $6 443 000’—

s 12 4 s 14 Electrical Safety Amendment Regulation (No. 3) 2005 No. 141, 2005 omit, insert— ‘$7307000’. 12 Amendment of s 209 (Obligations of employer about supervising training person) (1) Section 209— insert— ‘(1A) However, subsection (1) does not apply to a training person performing duties as a safety observer if— (a) the training person is a safety observer and has been capable of being a safety observer for at least 1 year immediately before the start of the training person’s apprenticeship or training program; and (b) the employer keeps a written record of the assessment mentioned in section 12, definition safety observer , paragraph (c) in relation to the training person.’. (2) Section 209(4)— insert — ‘ safety observer see section 12(2).’. 13 Amendment of s 211 (Provision of information by retail entity) Section 211— insert— ‘(k) for premises that are a domestic residence—whether an approved safety switch is installed for the domestic residence.’. 14 Replacement of sch 7 (Fees) Schedule 7— omit, insert—
