Electoral Regulations 2005

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Electoral Act 2004 .7 February 2005

1Short titleThese regulations may be cited as the Electoral Regulations 2005 . 2CommencementThese regulations commence on the day fixed under section 2 of the Electoral Act 2004. 3Interpretation (1)  In these regulations, unless the contrary intention appears – the Act means the Electoral Act 2004 . (2)  In these regulations, a reference to a form, quoted by a numeral, is to be construed as a reference to such of the forms in Schedule 1 as is indicated by the context. 4Contents of writ for electionFor the purposes of section 67 of the Act – (a) a writ for the holding of an Assembly election is to be in accordance with Form 1 ; and (b) a writ for the holding of a Council election is to be in accordance with Form 2 . 5Declaration by candidateFor the purposes of section 78 of the Act, the declaration referred to in section 77(2)(e), (3)(f), (4)(e) or (5)(f) of the Act is to be – (a) in the case of an Assembly nomination, in accordance with Form 3 ; and (b) in the case of a Council nomination, in accordance with Form 4 . 6Printing order for subsequent batches of ballot papersFor the purposes of clause 4 of Schedule 3 to the Act, the printing order for subsequent batches of ballot papers is to be as specified in Schedule 2 . EXPLANATORY NOTE

(This note is not part of the regulation) These regulations prescribe –

(a) the contents of writs for elections; and (b) the declaration to be made by candidates when nominating for election; and (c) the printing order for names on batches of ballot papers subsequent to the first batch.
