Regulations under the Electoral Act 2004
These Regulations may be cited as the
For the definition
(a) section 175P(2) or (3) of the Act is 0.5 penalty units; or
(b) section 215(1), (2) or (2A) of the Act is:
(i) for an individual – 10 penalty units; or
(ii) for a body corporate – 50 penalty units; or
(c) section 279(1) of the Act is $25.
(1) For section 32(1)(f) of the Act, a photograph of a nominee must:
(a) be a black and white, full faced vertical portrait of the nominee’s head and shoulders;
(b) have been taken within 6 months before lodgment of the nominee’s nomination; and
(c) have endorsed on the reverse side the nominee’s full name and a statement signed by the nominee certifying that the photograph was taken within the period mentioned in paragraph (b).
(2) However, the Electoral Commission may accept a photograph of a nominee that does not comply with subregulation (1) if the Commission is satisfied the nominee is readily recognisable in the photograph.
For section 32(1)(g) of the Act:
(a) the nomination deposit is $500; and
(b) the manner of payment of the nomination deposit is a single payment of the full nomination deposit; and
(c) the payment method is:
(i) by electronic transfer from an ADI to an account specified by the Commission; or
(ii) in cash.
4 Form of ballot paper
For section 40(1) of the Act, a ballot paper must be in Form 1 in the Schedule.
(1) For section 175L(2) of the Act, the register of associated entities must include the following information in respect of each associated entity:
(a) the full name of the entity;
(b) the address of the entity;
(c) name of registered party with which the entity is associated;
(d) the date of registration of the entity.
(2) For section 175M(2) of the Act, the register of third party campaigners must include the following information in respect of each third party campaigner:
(a) the full name of the campaigner;
(b) the address of the campaigner;
(c) the date of registration of the campaigner.
