30 ANNO VICESIMO SEXTO ELJ ABET AE SECUNDAE REGI N A E No . 6 of 1977 An Act to amend the Electoral DistrictsAct 1971 and the City of Brisbane - Act 1-924-1976 each in certain particulars [ASSENTED TO 5TH APRIL, 19771 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:--- PART I-PRELI_MINAR! 1. Short title. This Act may be cited as the Electoral Districts Act and Another Act Amendment Act 1977. 2. Arrangement of Act. This Act is divided into Parts as follows:- PART I-PRELIMINARY (SS. 1-2); PART 11-AMENDMENT OF ELECTORAL DISTRICTS ACT (ss. 3-7); PART 111-AMENDMENT OF CITY OF BRISBANE ACT (sS. 8-10). PART 1L-AMENDMENT OF ELECTORAL DISTRICTS ACT 3. Citation '. (1) In this Part the ElectoralDistrictsAct1971 is referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the Electoral Districts Act1971-1971.
Electcral Districts Act and Another Act Amendment Act 1977, No. 6 31 4. Amendment of s. 13. Section 13 of the Principal Act is amended by, in paragraph (a), adding after the words " that subsection " the expression ") ". 5. Amendment of s. 16. Section 16 of the Principal Act is amended by- (a) omitting from subsection (1) paragraph (a) and substituting the following paragraph:- (a) for that purpose the number of electors living in the Zone so affected shall be and be deemed to be the aggregate number of electors who on the prescribed date were, pursuant to the Elections Act 1915-1976, enrolled for all of the existing electoral districts within the boundaries of that Zone; "; (b) in paragraph (b) of subsection (1), inserting after the words " of this subsection " the words " (including reading a reference " the thirty-first day of December of the calendar year next preceding the date of appointment of the Commissioners " as a reference " the prescribed date ") " (c) omitting from subsection (2) paragraph (a) and substituting the following paragraph:-- (a) for that purpose the number of electors living in an Area so affected shall be and be deemed to be the aggregate number of electors who on the prescribed date were, pursuant to the Elections Act 1915-1976, enrolled for the two or, as the case may be, three existing electoral districts within that Area; "; (d) in paragraph (b) of subsection (2), inserting after the words of this subsection " the words " (including reading a reference " the thirty-first day of December of the calendar year next preceding the date of appointment of the Corr, missioners "as a reference " the prescribed date ") "• (e) adding at the end of the section the following subsection:- " (5) In this section the expression " the prescribed date " means such one of those dates, being the last day of April, August or December or other date substituted by Order in Council for any of those dates for the purposes of section 12 of the Jury Act 3929-1976, as is closest to and last precedes the appointment of Commissioners for the purposes of this Part IV.". 6. Amendment of s. 17. Section 17 of the Principal Act is amended by- (a) omitting subsection (4) and substituting the following subsection:- " (4) The general roil containing the names of electors for an electoral district as constituted immediately prior to the appointment of the Commissioners last prepared prior to the date of such appointment together with a supplemental roll of the names of all electors who, if that electoral district had continued to be so constituted, would have been entitled under-the Elections Act 1915-1976 to be added since the date to which that general roll is compiled to the roll of electors for that electoral district as so constituted shall, with and subject to all corrections and erasures of or from that general roll and supplemental roll made pursuant
32 Electoral Districts Act and Another Act Amendment Act 1977, No. 6 to the Elections Act 1915-1976, be the roll of electors for the purposes of any by-election for that electoral district held in accordance with the provisions of this section."; (b) in subsection (5)- (i) omitting the words " annual roll " and substituting the words " general roll "; (ii) omitting the words " The Elections Acts 1915 to 1965 " and substituting the words " the Elections Act 1915-1976 ". 7. Amendment of s. 23. Section 23 of the Principal Act is amended by- (a) omitting subsection (1) and substituting the following subsection:- " (1) The Principal Electoral Officer shall compile an electoral roll of the electors in each and every electoral district determined by Commissioners under Part IV of this Act and proclaimed by the Governor in Council and for that purpose there shall be for each and every such electoral district general rolls and supplemental rolls to the general rolls, which shall be prepared under and in accordance with the requirements of the Elections Act 1915-1976 which Act shall apply and extend accordingly. In respect of a determination of electoral districts by Commissioners under Part III of this Act the preceding paragraph shall be taken to have applied and to have read as if- (a) a reference " general rolls " therein were a reference " annual rolls "; and (b) a reference " the Elections Act 1915-1976 " therein were a reference " The Elections Acts 1915 to 1965. "." ; (b) omitting subsection (3) and substituting the following subsection:- " (3) The first such general roll for an electoral district determined by Commissioners under Part IV of this Act and proclaimed by the Governor in Council shall contain the names of electors registered as living in that district on the date when that district is proclaimed."; (c) in subsection (4), omitting the words " annual roll " where they twice occur and substituting in each case the words " general roll "; (d) in subsection (6)- (i) omitting the words " annual roll " and substituting the words " general roll "; (ii) omitting the words " The Elections Acts 1915 to 1965 " and substituting the words " the Elections Act 1915-1976 "; (iii) omitting the words " those Acts " and substituting the words " that Act ". PART 111 - AMENDMENT OF CITY of BRISBANE ACT S. Citation. ( 1) In this Part the City ofBrisbane Act1924-1976 is referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the Cit v of ` Brisbane Act 1924-1977.

Section 7 of the Principal Act is amended by omitting the words " annual roll " and substituting the words " general roll ". 10. Amendment of s. 14J. Section 141 of the Principal Act is amended by- (a) omitting from subsection (1) paragraph (a) and substituting the following paragraph:- (a) for that purpose the number of electors living in the Zone so affected shall be and be deemed to be the aggregate number of electors who, on such one of those dates, being the last day of April, August or December or other date substituted by Order in Council for any of those dates for the purposes of section 12 of the Jury Act1929-1976, as is closest to and last precedes the appointment of the Commissioners, were pursuant to the Elections Act enrolled for all of the existing electoral districts and parts, if any, of electoral districts as last constituted under the Electoral Districts Act1971, which are within the boundaries of that Zone; "; (b) in paragraph (b) of subsection (1) inserting after the words " of paragraph (a) " the words " (including reading a reference " the eighteenth day of April 1972 " as a reference to the date which, pursuant to paragraph (a), is the date on which the electors are to be enrolled for the purposes of the redistribution and of that paragraph) ".
