1954. No. 27.

REGULATIONS UNDER THE COMMONWEALTH ELECTORAL ACT 1918-1953 AND THE REFERENDUM (CONSTITUTION ALTERATION) ACT 1906-1936.*

 

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Commonwealth Electoral Act 1918-1953 and the Referendum (Constitution Alteration) Act 1906-1936.

Amendments of the Electoral and Referendum Regulations. 

1. Regulation 7 of the Electoral and Referendum Regulations is repealed and the following regulation inserted in its stead :—

“7. For the purposes of sub-section (1.) of section 37 of the Act, the prescribed prices are those specified in the table to this regulation.

Form of application for postal vote certificate and postal ballot-paper. Sec. 85.

2. Regulation 40 of the Electoral and Referendum Regulations is amended by inserting in the proviso to sub-regulation (1.), after the word “Subdivision” (last occurring), the words “, or where, in the case of an applicant temporarily outside Australia, the application is made to an Assistant Returning Officer at a place outside Australia”.

Form of postal vote certificate. Sec. 88.

3. Regulation 41 of the Electoral and Referendum Regulations is amended by omitting from sub-regulation (2.) the words “for which the elector named in the certificate declares that he is enrolled” and inserting in their stead the words “specified in the certificate”.

Forms of postal ballot-paper. Sec. 88.

4. Regulation 42 of the Electoral and Referendum Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (2.) the words “for which the voter declares that he is enrolled” and inserting in their stead the words “in which the election is to be held”;

(b) by omitting from paragraph (a) of sub-regulation (4.) the words “for which the voter declares that he is enrolled” and inserting in their stead the words “in which the election is to be held”; and

(c) by omitting sub-regulation (6.) and inserting in its stead the following sub-regulation:—

“(6.) Before issuing a postal ballot-paper for a referendum, the Divisional Returning Officer, Registrar or Returning Officer shall, if the name of the State printed on the ballot-paper is not the name of the State in which the election is to be held, strike out that name and insert the name of the State in which the election is to be held.”.

Postal ballot-paper received by Divisional Returning Officer or Assistant Returning Officer. Sec. 92 (2).

5. Regulation 45 of the Electoral and Referendum Regulations is amended by omitting from paragraph (iv) of sub-regulation (1.) the words “prior to eight o’clock in the evening of the fourth day after” and inserting in their stead the words “on or before the Friday immediately following”.

6. Regulation 47 of the Electoral and Referendum Regulations is amended by omitting from paragraph (d) the words “prior to eight o’clock in the evening of the fourth day after” and inserting in their stead the words “on or before the Friday immediately following”.

Absent Voters’ ballot-papers— action by Assistant Returning Officer. Sec. 113.

7. Regulation 56 of the Electoral and Referendum Regulations is amended by omitting from paragraph (c) the words “prior to eight o’clock in the evening of the fourth day after” and inserting in their stead the words “on or before the Friday immediately following”.

Action by Assistant Returning Officer.

8. Regulation 70 of the Electoral and Referendum Regulations is amended by omitting from paragraph (c) the words “prior to eight o’clock in the evening of the fourth day after “ and inserting in their stead the words “ on or before the Friday immediately following”.

Form 27.

9. Form 27 is amended by inserting, after the words—

“Returning Officer for the Territory of ”,

the words—

“or Assistant Returning Officer at ”.
