Electoral (Amendment) Act 1997

An Act to amend the Electoral Act 1992 and for related purposes

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Short title

1.  This Act may be cited as the Electoral (Amendment) Act 1997.

Commencement

2.  (1)  Sections 1, 2 and 3 commence on the day on which this Act is notified in the Gazette.

(2)  The remaining provision commences on 1 May 1998.

Principal Act

3.  In this Act, “Principal Act” means the Electoral Act 1992.1

Ordinary elections

4.  Section 100 of the Principal Act is amended—

(a)by omitting paragraph (1) (a) and substituting the following paragraph:

“(a)the first general election under this Act as amended by the Electoral (Amendment) Act 1997 shall be held on 20 October 2001;”;

(b)by omitting from paragraph (1) (b) “February” and substituting “October”; and

(c)by omitting subsection (2) and substituting the following subsection:

“(2) Where, but for this subsection, an election in accordance with subsection (1) would be held on the day on which an election of Senators, or a general election of members of the House of Representatives, would be held, the election shall be held on the 1st Saturday in December in the year in which it would, but for this subsection, be held.”.
