REGULATIONS UNDER THE EGG EXPORT CONTROL

ACT 1947-1951.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the EggExportControlAct 1947-1951.

Egg Export Control (Staff) Regulations.

Citation.

1. These Regulations may be cited as the Egg Export Control (Staff) Regulations.

Commencement.

2. These Regulations shall be deemed to have come into operation on the first day of January, 1948.

Definition.

3. In these Regulations, unless the contrary intention appears, “officer” means an officer appointed under section 12 of the EggExportControlAct 1947.

Salaries of officers.

4.—(1.) An officer who occupies an office specified in column 1 of the Schedule to these Regulations shall be entitled to be paid—

(a) in respect of his service between the thirty-first day of December, 1947, and the twenty-ninth day of December, 1949—the annual salary, or salary within the limits of salary, specified in column 2 of that Schedule opposite to that office and the increments of salary within those limits specified in column 3 of that Schedule;

(b) in respect of his service between the twenty-eighth day of December, 1949, and the thirtieth day of June, 1951— the annual salary, or salary within the limits of salary, specified in column 4 of that Schedule opposite to that office and the increments of salary within those limits specified in column 5 of that Schedule; and

(c) in respect of his service on and after the thirtieth day of June, 1951—the annual salary, or salary within the limits of salary, specified in column 6 of that Schedule opposite to that office and the increments of salary specified in column 7 of that Schedule.

(2.) An officer who occupies the office of Superintendent of Exports shall be entitled to be paid—

(a) the annual salary of £1,250 in respect of his service between the thirty-first day of December, 1947, and the first day of May, 1950;

(b) salary within the limits of £1,286-£1,472 and increments of £62 within those limits in respect of his service between the thirtieth day of April, 1950, and the thirtieth day of June, 1951; and

(c) salary within the limits of £1,490-£1,676 and increments of £62 within those limits in respect, of his service on and after the thirtieth day of June, 1951.

(3.) The salary of an officer under sub-regulation (1.) of this regulation during each of the periods specified in that sub-regulation and the salary of the Superintendent of Exports under the last preceding sub-regulation during each of the periods specified in paragraphs (b) and (c) of the last preceding sub-regulation shall be subject to variation from time to time in accordance with the provisions of regulation 106a of the Commonwealth Public Service Regulations as in force during each of those periods.

(4.) An officer shall not be entitled to an increment of salary until he has received salary without the increment for not less than twelve months.

Conditions of employment of officers.

5.— (l.) Subject to these Regulations, officers shall be employed under the same conditions with respect to leave of absence and holidays as those prescribed in relation to officers of the Commonwealth Public Service by the Commonwealth Public Service Act 1922-1947, or by that Act as amended, and under the same conditions with respect to attendance, performance of duties, hours of duty and overtime payment, and travelling and other allowances as those prescribed in relation to officers of the Commonwealth Public Service by the Commonwealth Public Service Regulations.

(2.) Where the Board certifies that the functions and duties of an officer, or officers included in a class of officers, employed by the Board are substantially similar to those of an officer, or officers included in a class of officers, in relation to whom a determination under the Arbitration (PublicService) Act 1920-1947, or under that Act as amended, specified in the certificate makes provision with respect to a matter specified in the last preceding sub-regulation, that officer, or the officers included in that class of officers, employed by the Board shall be employed under the same conditions with respect to that matter as are prescribed by the determination.

(3.) Where a condition of employment prescribed by sub-regulation (1.) of this regulation is inconsistent with a condition of employment prescribed by sub-regulation (2.) of this regulation, the latter shall prevail and the former shall, to the extent of the inconsistency, not apply to, or in relation to, officers.

(4.) For the purposes of this regulation, a reference in the Commonwealth Public Service Act 1922-1947, or in that Act as amended, the Commonwealth Public Service Regulations or a determination under the Arbitration (PublicService) Act 1920-1947, or under that Act as amended, to the Public Service Board, the Permanent Head or the Chief Officer shall be read as a reference to the Chairman of the Australian Egg Board.

Entertainment expenses.

6. The Board may make available to the Chairman for entertainment expenses incurred by officers of the Board an amount which shall not, except with the approval of the Minister, exceed Two hundred pounds in any twelve months, and the Chairman may reimburse an officer from the amount so made available such expenses as, in the opinion of the Chairman, the officer has incurred for entertainment.
