  1. This is an application, pursuant to s 40 of the Judiciary Act 1903 (Cth) for removal to this Court of proceeding PE/MI 59834 of 2015 in the Magistrates Court of Western Australia in which the applicant stands charged with one count of unlawful assault of a person in the course of providing a health service to the public, contrary to s 318(1)(i)(ii) of the Criminal Code (WA).

  2. The applicant has not demonstrated any basis for removal of the proceeding to this Court or any reason which warrants fragmentation of the proceeding.

  3. Pursuant to r 26.07.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs which are fixed in the sum of $2,000.
