Education (Teachers Registration) Regulations 1996

under the Education Act 1972

1—Short title

These regulations may be cited as the Education (Teachers Registration) Regulations 1996.

2—Commencement

These regulations will come into operation on 1 September 1996.

3—Revocation

The Teachers Registration Regulations 1975 (see Gazette 26.6.1975 p2469), as varied, are revoked.

4—Interpretation

In these regulations—

Act means the Education Act 1972;

authority means an authority under section 63(1) of the Act;

Board means the Teachers Registration Board.

5—Prescribed kindergarten

For the purposes of paragraph (b) of the definition of recognised kindergarten in section 5(1) of the Act, a kindergarten that—

  1. (a)

    provides a course of training and instruction to children aged three to five years; and

  2. (b)

    is not a licensed child care centre under the Children's Services Act 1985,

is a prescribed kindergarten.

6—Prescribed qualifications and experience for registration as teacher

  1. (1)

    For the purposes of section 61(1)(b)(i) of the Act, the qualifications required for registration as a teacher are as follows:

    1. (a)

      an approved teacher education degree, diploma or other qualification awarded on satisfactory completion of a tertiary course of pre-service teacher education in pre-primary, primary or secondary education that—

      1. (i)

        is of at least three years' full-time duration or part-time equivalent duration; and

      2. (ii)

        includes a practical student teaching component; or

    2. (b)

      —

      1. (i)

        an approved non-teacher education degree, diploma or other qualification awarded on satisfactory completion of a tertiary course that is of at least three years' full-time duration or part-time equivalent duration; and

      2. (ii)

        an approved postgraduate degree, diploma or other qualification awarded on satisfactory completion of a tertiary course of pre-service teacher education in pre-primary, primary or secondary education that—

        1. (A)

          is of at least one year's full-time duration or part-time equivalent duration; and

        2. (B)

          includes a practical student teaching component.

  2. (2)

    For the purposes of section 61(1)(b)(i) of the Act, the experience required for registration as a teacher is one year's full-time (or part-time equivalent of 200 days') satisfactory service as a teacher in a Government or registered non-Government school.

  3. (3)

    In this regulation—

approved, in relation to a degree, diploma or other qualification, means—

  1. (a)

    a degree, diploma or other qualification awarded by a tertiary education institution that is a member of the Australian Vice-Chancellor's Committee; or

  2. (b)

    a degree, diploma or other qualification that was at any time nationally registered by the former Australian Council on Awards in Advanced Education or the former Australian Council on Tertiary Awards.

7—Application for registration or renewal of registration

  1. (1)

    An application for registration as a teacher must—

    1. (a)

      be made in the manner and form determined by the Board; and

    2. (b)

      contain the information and be accompanied by the documents required by the application form; and

    3. (c)

      be accompanied by the following fees:

      1. (i)

        $69; plus

      2. (ii)

        if the applicant's qualifications for registration consists of or includes qualifications obtained outside this State—$50; plus

      3. (iii)

        if the application is made by a person whose name has been removed from the register following a failure to apply for an extension of the period of registration before the expiry of the registration—a fee of $23.

  2. (2)

    An application for an extension of the period of registration as a teacher must—

    1. (a)

      be made in the manner and form determined by the Board; and

    2. (b)

      contain the information and be accompanied by the documents required by the application form; and

    3. (c)

      be accompanied by a fee of $69; and

    4. (d)

      be lodged with the Board before expiry of the registration.

8—Certificate of registration

  1. (1)

    On registration of a person as a teacher, the Registrar must issue to the person a certificate of registration in a form determined by the Board.

  2. (2)

    If a person satisfies the Board by statutory declaration that his or her certificate of registration as a teacher has been lost or destroyed, the Registrar must, on payment of a fee of $23, issue to the person a duplicate certificate of registration.

9—Application for authority to unregistered teacher

An application for an authority must—

  1. (a)

    be made in the manner and form determined by the Board; and

  2. (b)

    contain the information and be accompanied by the documents required by the application form; and

  3. (c)

    be accompanied by the appropriate fee prescribed by the Fees Regulation (Education) Regulations 1990 (see Gazette 12.7.1990 p285) as varied.

10—Duty to notify change of address

A registered teacher or person who holds an authority must, within 28 days of changing his or her residential address, notify the Board in writing of the change.

Maximum penalty: $50.

11—Return of certificate of registration

If the registration of a person as a teacher is cancelled, the person must, at the direction of the Registrar, return the certificate of registration to the Registrar.

Maximum penalty: $50.

12—Duty of principal or person in charge of registered non-Government school or recognised kindergarten

A principal or person in charge of a registered non-Government school or a recognised kindergarten must, within 28 days of receipt of a written request by the Board, furnish to the Board in the manner and form specified in the request, specified details relating to each person engaged in teaching at the school or kindergarten on a specified date.

13—Duty of Director-General

The Director-General must, within 28 days of receipt of a written request by the Board, furnish to the Board in the manner and form specified in the request, specified details relating to each person engaged in teaching at Government schools on a specified date.

14—Accounts and audit

  1. (1)

    The Board must cause proper accounts to be kept of its financial affairs and financial statements to be prepared in respect of each financial year.

  2. (2)

    The financial statements must include a statement of funds held by the Board as at 30 June in the financial year to which the financial statements relate.

  3. (3)

    The Auditor-General may at any time, and must at least once in every year, audit the accounts and financial statements of the Board.

  4. (4)

    A copy of the accounts and financial statements, as audited by the Auditor-General, must be included in the Board's annual report.

  5. (5)

    The Board must cause the audited financial statements to be published and made available to registered teachers.

15—Annual report

The Board must, on or before 31 March in each year, submit to the Minister a report on the work and activities of the Board during the previous calendar year.

16—Remission of fees

The Board may, if satisfied that reasonable cause exists for doing so, remit a fee prescribed these regulations in whole or in part.

17—False or misleading information

A person must not, in providing any information required under these regulations, make a statement knowing that it is false or misleading in a material particular (whether by reason of the inclusion or omission of any particular).

Maximum penalty: $200.

Revocation of regulations

The Education (Teachers Registration) Regulations 1996 were revoked by Sch 1 of the Teachers Registration and Standards Regulations 2005 on 31.3.2005.
