1  Name

This instrument is the Education Services for Overseas Students (TPS Levies) (Administrative and Base Fees) Determination 2022.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under section 7A of the Education Services for Overseas Students (TPS Levies) Act 2012.

4  Schedules

Each instrument that is specified in a Schedule to this instrument is repealed as set out in the applicable items in the Schedule concerned.

5  Definitions

Note:          A number of expressions used in this instrument are defined in the Act, including the following:

(a)    administrative fee component; and

(b)    base fee component.

In this instrument:

Act means the Education Services for Overseas Students (TPS Levies) Act 2012.

6 Determination of administrative fee component

For the purposes of section 6 of the Act, the following dollar amounts are determined for the calendar year beginning on 1 January 2023:

(a)    the amount for the purposes of paragraph 6(a) is $99.00; and

(b)  the amount for the purposes of paragraph 6(b) is $0.51.

Note:          Amounts specified for the purposes of paragraphs 6(a) or (b) of the Act are subject to indexation in accordance with section 8 of the Act unless an instrument is made under section 7A of the Act for a later calendar year.

7 Determination of base fee component

For the purposes of section 7 of the Act, the following dollar amounts are determined for the calendar year beginning on 1 January 2023:

(a)    the amount for the purposes of paragraph 7(a) is $199.00; and

(b)  the amount for the purposes of paragraph 7(b) is $1.26.

Note:          Amounts specified for the purposes of paragraphs 7(a) or (b) of the Act are subject to indexation in accordance with section 8 of the Act unless an instrument is made under section 7A of the Act for a later calendar year.
