s1 2 s5 Education (Senior Secondary School Studies) No. 108, 2000 Amendment (No. 1) ˙ Short title 1. This by-law may be cited as the Education (Senior Secondary School Studies) Amendment By-law (No. 1) 2000 . ˙ Commencement 2. Section 6 commences on 1 July 2000. ˙ By-law amended 3. This by-law amends the Education (Senior Secondary Schools Studies) By-law 1999 . ˙ Insertion of new pt 5, s 30A 4. Part 5, after section 30— insert — ˙ ‘ Confidentiality of lists of information under s 30 ‘ 30A.(1) This section applies to a person who, in performing functions under the Act has access to, or custody of, a list of information under section 30. ‘ (2) The person must not disclose the information, or give the list or access to the list, to anyone else. ‘ (3) However, the person may disclose the information or give access to the list to someone else— (a) to the extent necessary to perform the person’s functions under the Act; or (b) if the disclosure or giving of access is otherwise required or permitted by law.’. ˙ Replacement of pt 10 (Repeal) 5. Part 10— omit, insert —

In this part— “aggrieved person” means a person aggrieved by a decision of the board under section 5(4), 7(4), 8(4), 9(1), 20(1) or 27(2) 1 . “court” means a Magistrates Court constituted by a magistrate. ˙ ‘ Appeals ‘ 45.(1) An aggrieved person may appeal to a court against the decision by which the person is aggrieved. ‘ (2) The appeal is to be started by filing a notice of appeal in the court, within 28 days after the aggrieved person receives notice of the decision appealed against. ‘ (3) The appeal is by way of a rehearing on the material before the board when it made the decision. ‘ (4) The court may— (a) allow the appeal and make any order the court considers appropriate; or (b) dismiss the appeal.’. ˙ Replacement of sch 1 (Fees) 6.
