EDUCATION REGULATIONS.

PAST I.—PRELIMINABY.

1. These Regulations may be cited as the Education Regulations, ottetton. 2. All regulations made in pursuance of the Education Ordinance aepeai.

1928, or under that Ordinance as subsequently amended, and in force immediately prior to the commencement of the Education Ordinance 1937, and the regulations made under the Education Ordinance 1937- 1938 on the nineteenth day of December, 1938, are repealed.

3. These Regulations are divided into Parts, as follows:-— rarte.

4.— (1.) In these Regulations, unless the contrary intention Definition*,

appears—

" Attendance Inspector" means an Attendance Inspector

appointed under section 7 of the Ordinance;

" Director of Education " means the Director of Education of the

State of New South Wales;

" Inspector of Schools" means an Inspector appointed under

the Public Service Act 1902 of the State of New South

Wales for the purposes of the Public Instruction Act of 1880,

the Public Instruction (Amendment) Act, 1916 and the Public Instruction (Amendment) Act, 1917 of that State;

• Notified in the Commonwealth Gazette on 20th August, 1942.

" Leaving Certificate Examination " means the Leaving Certifi- cate Examination conducted by the Department of Education of the State of New South Wales;

" Intermediate Certificate Examination " means the Intermediate Certificate Examination conducted by the Department of Education of the State of New South Wales;

"public school" means a school established or maintained by or

on behalf of the Commonwealth;

" secondary school", for the purposes of Part IV. of these Regulations, includes a High School established or main- tained by or on behalf of the Commonwealth;

" the City Area " means the City Area as defined in the City

Area Leases Ordinance 1936-1938;

" the Board " means the Bursary Endowment Board of the State

of New South Wales;

" the Fund " means the Bursary Endowment Fund established

under these Regulations;

" the Ordinance " means the Education Ordinance 1937-1942, as

amended from time to time;

" the Registrar " means the Registrar of Schools appointed under

section 7 of the Ordinance;

(2.) Any reference to a Form in these Regulations shall be read as a reference to a Form in the First Schedule to these Regulations.

P A R T I I I .—CONVEYANCE OF SCHOOL CHILDREN.

16.— (1.) Where the Minister is satisfied that a satisfactory arrange- Grants in aid ment for the conveyance of children to and from any school in the °j SJiSJS'to Territory has been made by the parents or guardians of those children, and from school,

the Minister may, subject to this P a r t of these Regulations, approve of a grant to the parent or guardian of any such child in aid of the conveyance of that child to and from school at the prescribed rate.

(2.) The parent or guardian of any child in respect of whom a grant in aid of conveyance is claimed shall fill in and forward to the Registrar a form of application in accordance with Form 12 and shall make a statutory declaration in accordance with Form 14 and shall furnish such other information as the Registrar requires.

(3.) A grant in aid of conveyance shall be payable as on and from the date on which an application in accordance with the last preceding sub-regulation is made.

17. Subject to the next succeeding regulation, a grant in aid of children in

conveyance may be claimed in respect of the following children:— wnom'grant

( a ) Any child over the age of six years and under the age of eleven years living more than two miles from the school; and

(b) Any child over the age of eleven years living more than

three miles from the school,

the distance in each case being by the nearest practicable walking

Provided that, where children are not conveyed the full distance from their homes, grants in aid of their conveyance may be made where the distance they are actually conveyed exceeds two miles.

18.—(1.) A grant in aid of conveyance shall not be payable or circumstances
continue to be payable in respect of the following classes of children:— no^aysS?"

(a) Children who have completed three years of s-uper-primary or secondary work from the time of leaving any primary school;

(6) Children the income of whose parents or guardians during the year ended on the thirtieth day of June preceding the date of the application, or on any subsequent thirtieth day of June, after deduction is made of any amount necessarily expended in the treatment or support of any invalid wholly or partially dependent on such parents or guardians, exceeds a quota of £80 for each member of the family, other than such invalid, including the parents or guardians, and excluding children earning a wage of 15s. or more weekly:

Provided that this sub-regulation shall not affect any boy or girl whose parents' or guardians' income during the relevant year, before making such deduction, is lessJk

(c) Children who travel to and from school by bicycle; and

(d) Children who may travel to and from school by motor

omnibus or other conveyance at a fare not exceeding one
penny per journey.

(2.) I t shall be the duty of every parent or guardian of a child in respect of whom a grant in aid of conveyance has been made—

(a) to inform the Registrar of any change in circumstances by reason of which the grant ceases to be payable within one month after the end of the year in which the change takes place; and
(b) whenever required by the Registrar, to furnish a statutory declaration in accordance with Form 14 having reference to the year ended on any thirtieth day of June specified by the Registrar.

Penalty: Ten pounds.

(3.) I t shall be a defence to a prosecution under paragraph (a) of the last preoeding sub-regulation to prove that the Registrar was informed, within the period mentioned in that sub-regulation, of the change in circumstances, by any one parent or guardian, of the child in respect of whom the grant was made.

22.— (1.) The Minister may establish a Bursary Endowment Fund Bursary

A bursary may be withdrawn by the Minister at any time during its currency if the holder ceases to be eligible to continue to hold a bursary, or fails to attend classes regularly and punctually, or fails to give evidence of satisfactory progress, or if the report of the Principal of the school or college upon the conduct of the holder is not satisfactory.

29.—(1.) Parents or guardians of candidates for bursaries shall fill in and forward to the Registrar a form of application in accordance with Form 13, and one of the parents or guardians in each case sha l l ^^

(2.) The Minister or the Board may reject any application for a bursary where the form of application and statutory declaration are not completed in accordance with these Regulations.

Division 2.—Bursaries Admitting to a Course of Secondary

Instruction.

30. Bursaries, of such number as is determined by the Minister, may, subject to these Regulations, be awarded annually by the Board to boys and girls who arc not less than 11 years of age and not more than 13 years of age on the date fixed for the qualifying examination for bursaries, and who, in the opinion of the Board, show the greatest merit in that qualifying examination.

31.—(1.) Each bursary shall comprise a grant of £40 for the first year's course, £40 for the second, £40 for the third, £50 for the fourth and £50 for the fifth year's course, to holders who may have to live away from home in order to attend the school they have selected, or a grant of £12 for the first year's course, £12 for the second, £12 for the third, £18 for the fourth, and £24 for the fifth year's course, to 1

(2.) Any such bursary shall be tenable for one year but may be renewed for a further period not exceeding two years if the holder is Dot apprenticed during that period and if the Minister is satisfied that the circumstances justify the extension.

(a) In the case of a youth who must necessarily live away from home in order to attend the Canberra Technical College— £40 in respect of the first year's course and £50 in respect of any succeeding year or, where any such youth has passed the Intermediate Examination, £50 in respect of each year of the tenure of the bursary; or

(b) In the case of a youth living at home and able to travel to and from home and the College daily—£12 in respect of the first year's course and £25 in respect of any succeeding year or, where any such youth has passed the Inter- mediate Examination, £25 in respect of each year of the tenure of the bursary.

1. This Return should be kept in progress week by week and forwarded to the Registrar of Schools, Department of the Interior, Canberra, by the first available post after the last school term.

2. This Return is intended to show the enrolment and attendance of all

children, irrespective of age.

3. Where there are Secondary, Primary, and Infants ' Departments connected with one school, a separate return is required for each department.

4. A duplicate of this Return should be kept in the school.

5. The teacher should—
In column (a) Enter the number of pupils enrolled up to this period. The

names are to be kept on the Roll for the whole of the term but no name should be entered on the Roll for the succeeding term until the pupil is in actual attendance. The names of pupils who leave school permanently during the term should be ruled off lightly in the Roll- book at the end of the te rm;

(b) Deduct from the total enrolment the number of pupils who

have left the school each week;

(c) Add together the attendances for each day and divide by

the number of school days in each week;
