EDUCATION REFORM ACT 1990 - REGULATION

(Relating to the Board of Studies)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Education Reform Act 1990, has been pleased to make the Regulation set forth hereunder.

Citation

1. This Regulation may be cited as the Education Reform (Transitional) Regulation 1990.

Commencement

2. This Regulation commences on 8 June 1990.

Exercise of Board’s functions

3. (1) The functions of the Board of Secondary Education under the Education and Public Instruction Act 1987, or any other Act, may be exercised by the Board of Studies.

(2) For the purpose of this clause, a reference in any such Act (or an instrument made under any such Act) to the Board of Secondary Education is to be read as a reference to the Board of Studies.

(3) This clause ceases to have effect on the commencement of section 102 of the Education Reform Act 1990.

EXPLANATORY NOTE

The object of this Regulation is to make a transitional arrangement consequent on the proposed commencement of the provisions of the Education Reform Act 1990 relating the establishment of the Board of Studies and the proposed repeal of the provisions of the Education and Public Instruction Act 1987 relating to the establishment of the Board of Secondary Education. Pending the full commencement of the Education Reform Act 1990, the Regulation enables the Board of Studies to exercise the functions of the Board of Secondary Education under those provisions of the Education and Public Instruction Act 1987 that remain in force.
