1Short titleThese regulations may be cited as the Education Providers Registration (Overseas Students) Regulations 2005 . 2CommencementThese regulations take effect on 1 January 2006. 3RecordsFor the purposes of section 22 of the Education Providers Registration (Overseas Students) Act 1991 , the following records are prescribed: (a) details of the name, gender and place of origin of each overseas student for whom the registered education provider provides an education service; (b) details of the registered education services provided to an overseas student referred to in paragraph (a); (c) details of the fees paid by an overseas student referred to in paragraph (a) in relation to – (i) the provision of registered education services; and (ii) the accommodation and living expenses of that overseas student; (d) a register of registered education services advertised, offered or provided to overseas students or prospective overseas students. 4FeesThe fees specified in Schedule 1 are prescribed as the fees payable in respect of the matters to which they respectively relate. EXPLANATORY NOTE

(This note is not part of the regulation) These regulations –

(a) prescribe certain records for the purposes of section 22 of the Education Providers Registration (Overseas Students) Act 1991 ; and (b) prescribe the fees payable for certain applications under that Act; and (c) are made consequentially on the repeal of the Education Providers Registration (Overseas Students) Regulations 1992 under section 11 of the Subordinate Legislation Act 1992 .
