Education Legislation Amendment Regulation (No. 1) 2012 Part 1 Preliminary [s 1] Part 1 Preliminary 1 Short title This regulation may be cited as the Education Legislation Amendment Regulation (No. 1) 2012 . 2 Commencement This regulation commences on 9 July 2012. Part 2 Amendment of Education (Accreditation of Non-State Schools) Regulation 2001 3 Regulation amended This part amends the Education(AccreditationofNon-StateSchools) Regulation 2001. 4 Amendment of s 10 (Health, safety and conduct of staff and students) Section 10(5)(a)— omit , insert ‘(a) a process for reporting— (i) sexual abuse or suspected sexual abuse in compliance with the Education(GeneralProvisions) Act 2006 , section 366; and (ii) a suspicion of likely sexual abuse in compliance with the Education (General Provisions) Act 2006 , section 366A;’. Part 3 Education Legislation Amendment Regulation (No. 1) 2012 Part 3 Amendment of Education (General Provisions) Regulation 2006 [s 5] Amendment of Education (General Provisions) Regulation 2006 5 Regulation amended This part amends the Education(GeneralProvisions)Regulation 2006. 6 Amendment of s 68 (Report about sexual abuse—Act, ss 365(3) and 366(3)) (1) Section 68(c), ‘an employee of the school’— omit , insert ‘another person’. (2) Section 68(e)(ii), ‘employee’— omit , insert ‘person’. 7 ‘68A Insertion of new s 68A After section 68— insert Report about likely sexual abuse—Act, ss 365A(4) and 366A(5) ‘A report under section 365A(4) or 366A(5) of the Act must include the following particulars— (a) the name of the person giving the report (the first person ); (b) the student’s name and sex; (c) details of the basis for the first person reasonably suspecting that the student is likely to be sexually abused by another person; 2012 SL No. 32 Page 3
Education Legislation Amendment Regulation (No. 1) 2012 Part 3 Amendment of Education (General Provisions) Regulation 2006 [s 7] (d) any of the following information of which the first person is aware— (i) the student’s age; (ii) the identity of the person who is suspected to be likely to abuse the student; (iii) the identity of anyone else who may have information about the suspected likelihood of abuse.’.
