s1 2 s4 Education (General Provisions) Amendment Regulation (No. 2) 2003 No. 323, 2003 1 Short title This regulation may be cited as the Education (General Provisions) Amendment Regulation (No. 2) 2003 . 2 Commencement This regulation commences on 1 January 2004. 3 Regulation amended This regulation amends the Education(GeneralProvisions)Regulation 2000. 4 Replacement of ss 12 and 13 Sections 12 and 13— omit, insert— ‘12 Liquor not to be taken onto premises in dry places (1) The Minister or authorised officer must not approve an application to take liquor onto premises if the premises are a dry place or are part of a dry place. (2) In this section— “dry place” means a place declared under the CommunityServices(Aborigines) Act 1984 , section 96, or the Community Services (TorresStrait) Act 1984 , section 94, 1 as a dry place. ‘13 Approval for liquor to be taken onto premises in restricted areas (1) The Minister or authorised officer may approve an application for a person to take liquor onto premises in a restricted area only if— (a) the application relates to a social function and the person holds a restricted area permit authorising the person to possess liquor in the restricted area for the social function; or 1 CommunityServices(Aborigines)Act1984 , section 96 (Declaration) and Community Services (Torres Strait) Act 1984 , section 94 (Declaration)
s5 3 s6 Education (General Provisions) Amendment Regulation (No. 2) 2003 No. 323, 2003 (b) for a person who does not hold a restricted area permit mentioned in paragraph (a)—the quantity of liquor the person may take onto the premises under the approval is not more than the prescribed quantity of liquor for the restricted area. (2) If the Minister or authorised person approves an application under subsection (1)(a), the approval must be— (a) only for the times stated in the restricted area permit; and (b) subject to any other conditions to which the permit is subject. (3) In this section— “prescribed quantity” , of liquor, means the quantity of liquor, stated in a regulation made under the LiquorAct1992 , section 173H, 2 that a person may have in possession in a public place in a restricted area without a restricted area permit. “public place” see the Liquor Act 1992 , section 4. 3 “restricted area” means an area declared under the LiquorAct1992 , section 173G(1), 4 to be a restricted area. “restricted area permit” means a restricted area permit granted and held under the Liquor Act 1992 . 5 ’. 5 Amendment of s 64 (Remote area agricultural college allowance) Section 64, ‘$1 410’— omit, insert— ‘$1 449’. 6 Amendment of sch 1 (Allowances) Schedule 1, parts 1 to 5— omit, insert— 2 Liquor Act 1992 , section 173H (Declaration of prohibition of possession of liquor in restricted area) 3 Liquor Act 1992 , section 4 (Definitions) 4 Liquor Act 1992 , section 173G (Declaration of restricted area) 5 See the Liquor Act 1992 , section 97(f) (Available permits).

For each student in years 8 to 12 . . . . . . . . . . . . . . . . . 1 454.20 ‘PART 3—ALLOWANCE FOR STUDENT HOSTELS ‘Division 1—If GST is not payable For a hostel boarding— (a) up to 8 students—$8 968.00 each year; or (b) 9 to 20 students—$8 968.00 plus $1 121.00 for each student more than 8 students each year; or (c) more than 20 students—$22 420.00 plus $748.00 for each student more than 20 students each year. ‘Division 2—If GST is payable For a hostel boarding— (a) up to 8 students—$9 864.80 each year; or (b) 9 to 20 students—$9 864.80 plus $1 233.10 for each student more than 8 students each year; or (c) more than 20 students—$24 662.00 plus $822.80 for each student more than 20 students each year.
s6 6 s6 Education (General Provisions) Amendment Regulation (No. 2) 2003 No. 323, 2003 ‘PART 4—REMOTE AREA TUITION ALLOWANCE 1. For a primary school— (a) if the charge for tuition is not more than $1 153—the amount of the charge; or (b) if the charge for tuition is more than $1 153—$1 153 plus 50c for each dollar charged that is more than $1 153, to a maximum of $2 307. 2. For a secondary school— (a) if the charge for tuition is not more than $1 662—the amount of the charge; or (b) if the charge for tuition is more than $1 662—$1 662 plus 50c for each dollar charged that is more than $1 662, to a maximum of $3 324. 3. For a school that does not distinguish between primary and secondary education for certain students with disabilities and provides only special education for those students— (a) for a student who will be less than 13 years at the end of the year for which the allowance is paid— (i) if the charge for tuition is not more than $1 153—the amount of the charge; or (ii) if the charge for tuition is more than $1 153—$1 153 plus 50c for each dollar charged that is more than $1 153, to a maximum of $2 307; and (b) for a student who will be 13 years or more at the end of the year for which the allowance is paid— (i) if the charge for tuition is not more than $1 662—the amount of the charge; or (ii) if the charge for tuition is more than $1 662—$1 662 plus 50c for each dollar charged that is more than $1 662, to a maximum of $3 324.

For a student who travels— (a) from a home in area 1 to a place in area 3—$908; or (b) from a home in area 2 to a place in area 3— (i) if the shortest trafficable route by road is via area 1—$908; or (ii) otherwise—$302; or (c) from a home in area 3 to a place in area 3— (i) if the shortest trafficable route by road is via area 2—$302; or (ii) otherwise—$101. 2. For a student who travels to a place in area 1 or area 2 and the most convenient direct route by road is— (a) not more than 150 km and takes— (i) not more than 3 h—$101; or (ii) more than 3 h but not more than 4 h—$202; or (iii) more than 4 h—$302; or (b) more than 150 km but not more than 300 km and takes— (i) not more than 4 h—$202; or (ii) more than 4 h—$302; or (c) more than 300 km—$302. 3. In this part— “area 1” see part 6, division 1. “area 2” see part 6, division 2. “area 3” see part 6, division 3.’.
