s1 3 s5 Education (General Provisions) Amendment No. 467, 1997 (No. 2) ˙ Short title 1. This regulation may be cited as the Education (General Provisions) Amendment Regulation (No. 2) 1997 . ˙ Commencement 2. This regulation commences on 1 January 1998. ˙ Regulation amended 3. This regulation amends the Education(GeneralProvisions)Regulation 1989 . ˙ Amendment of s 3 (Definitions) 4. Section 3— insert “school council” , for a State school, means the school council established under section 30X 1 of the Act for the school.’. ˙ Amendment of s 4 (Management of school) 5. Section 4— insert— (2) Without limiting subsection (1), the principal has the following responsibilities— (a) promoting educational practices at the school that lead to the improvement of student learning outcomes; (b) managing the school in a way that promotes— (i) effective, efficient and appropriate management of public resources; and 1 Section 30X (Establishment)

Section 7(1), ‘progressive’— omit, insert— ‘appropriate’. ˙ Amendment of s 8 (Charge of school in temporary absence of principal) 7. s 11 5 s 12 Education (General Provisions) Amendment No. 467, 1997 (No. 2) insert ˙ Circumstances in which school council to be dissolved—Act, s 30ZW 18B.(1) Subsection (2) prescribes a circumstance in which a school council is dissolved under section 30ZW(1)(b) 2 of the Act. (2) The circumstance is the non-compliance by the school council with a direction given to it under section 30ZZA 3 of the Act by the time stated in the direction.’. ˙ Replacement of s 19 (Use of State educational institutions) 11. Section 19— omit, insert ˙ Permission to use State educational institutions 19.(1) A person may apply for permission to use a State educational institution to either of the following— (a) the Minister; (b) an authorised officer. (2) If the applicant wants to use the State educational institution for a social function during which liquor is to be consumed, the applicant must also obtain the written approval of the Minister or the authorised officer, under section 19A, to take liquor onto the premises.’. ˙ Amendment of s 19A (Approval for liquor to be taken onto premises of a State educational institution) 12.(1) Section 19A(1), after ‘apply to’— insert ‘the Minister or’. 2 Section 30ZW (Dissolution of school council) 3 Section 30ZZA (Minister’s power to give directions in the public interest)

(2) Section 31(1) to (2)— omit, insert 31.(1) The principal of a State school must— (a) bring to the attention of a parent of a student the continued absence from school of the student; and (b) ask the parent to explain the reason for the continued absence.’. (3) Section 31(3), ‘and’ to ‘attendance’— omit .
s 20 8 s 20 Education (General Provisions) Amendment No. 467, 1997 (No. 2) (4) Section 31(4), ‘but’ to ‘absence’— omit . ˙ Amendment of s 32 (Compulsory attendance) 20.(1) Section 32(1)(a)— omit, insert— ‘(a) who live less than 16 km from, and less than 4.5 km from a school transport service to, the school; and’. (2) Section 32(1)(c) and (d)— omit, insert ‘(c) who have not attended the school for all the school days in the month, for the program of instruction for which they are each enrolled; and ‘(d) for whom there is no dispensation or provisional dispensation granted under section 58 4 of the Act for the days of non-attendance.’. (3) Section 32(2)— omit, insert (2) The principal must— (a) promptly forward a copy of the list to the police officer in charge of the local police station; and (b) keep a record of the information stated in the list.’. (4) Section 32— insert (4) In this section— 4 Section 58 (Dispensation from compliance with compulsory enrolment and attendance provisions)
s 21 9 s 23 Education (General Provisions) Amendment No. 467, 1997 (No. 2) “school transport service” has the meaning given in section 58(6) of the Act. 5 ’. ˙ Amendment of s 33 (Enrolment requirements) 21.(1) Section 33(2) and (4), ‘executive director’— omit, insert— ‘principal’s supervisor’. (2) Section 33(3) and (4), ‘teacher-in-charge’— omit, insert— ‘principal’. (3) Section 33(5), ‘or teacher-in-charge’— omit . ˙ Amendment of s 34 (Transfer of student) 22.(1) Section 34(2)(a), ‘triplicate’— omit, insert— ‘duplicate’. (2) Section 34(2)(d)— omit, insert ‘(d) keep a record of the information stated in the transfer.’. ˙ Amendment of s 35 (Transfer of student records) 23. Section 35, ‘record cards’— 5 Section 58(6) of the Act provides that “school transport service” means— (a) a school transport service approved by the chief executive of the department that deals with matters arising under the Transport Operations(Passenger Transport) Act 1994 ; or (b) a public transport service.

For section 62(1) 6 of the Act, the hours prescribed for attendance at school of a child of the age of compulsory attendance are from 8.00 am to 4.00 pm on a school day for the school at which the child is enrolled.’. ˙ Amendment of s 40 (Formation of an association) 25. Section 40(2), ‘executive director’— omit, insert— ‘principal’s supervisor’. ˙ Omission of s 43 (Subscription for membership) 26. Section 43— omit . ˙ Amendment of s 44 (Register of members) 27. Section 44(2)— 6 Section 62(1) states— ‘A parent shall not employ or cause or permit to be employed during the hours prescribed under a regulation for attendance at school the parent’s child who is of the age of compulsory attendance unless there is in existence at the material time, in respect of that child, a dispensation granted in accordance with section 58(1). Maximum penalty—5 penalty units.’

(2) A person who applies for membership of an association is taken to be a member of the association if— (a) the person does not receive written notice of the association’s decision on the application within 2 months after the application is made; or (b) the person receives notice of the association’s refusal of the application, but does not receive written notice of the reasons for the refusal, within 2 months after the application is made.’. ˙ Amendment of s 52 (Constitution to be framed) 29. Section 52(3)(a)— omit, insert ‘(a) the way in which a person becomes a member of the association and maintains membership;’.
