This regulation may be cited as the Education (General Provisions) Amendment Regulation (No. 1) 1997 . ˙ Regulation amended 2. This regulation amends the Education(GeneralProvisions)Regulation 1989 . ˙ Replacement of s 15 (Instruction for overseas students) 3. Section 15— omit, insert— ˙ Courses for overseas students 15.(1) An overseas student or intending overseas student may apply to the chief executive to enrol in an approved course in a State school. (2) A person who does not live in Australia may apply to the chief executive to enrol in an approved course in a State educational institution offering distance education. (3) An application under subsection (1) or (2) must be— (a) made in the approved form; and (b) accompanied by the fee for the course fixed by the chief executive under the FinancialAdministrationandAuditAct1977 , section 36(2). (4) The chief executive may grant the application if the chief executive is satisfied the person— (a) is fully financially supported; and (b) is academically qualified to be enrolled; and (c) has an adequate standard of English; and (d) is of good health; and (e) has adequate arrangements for accommodation, welfare and supervision.
s3 3 s3 Education (General Provisions) Amendment (No. 1) No. 59, 1997 (5) In this section— “approved course” means— (a) a registered course within the meaning of the Education(Overseas Students) Act 1996 ; or (b) a course of primary or secondary education approved by the Minister for this section. “intending overseas student” means a person who intends to become an overseas student. “overseas student” means a person who holds a student visa issued under the Migration Act 1958 (Cwlth).’.
