Education (Capital Assistance) Amendment Regulation (No. 1) 2012 [s 1] 1 Short title This regulation may be cited as the Education (Capital Assistance) Amendment Regulation (No. 1) 2012 . 2 Commencement This regulation commences on 24 February 2012. 3 Regulation amended This regulation amends the Education(CapitalAssistance)Regulation 2005. 4 Insertion of new schedule, pt 5 Schedule— insert— ‘Part 5 Flying start capital assistance scheme ‘6 Application—flying start capital assistance scheme ‘(1) For an application about assistance under a scheme referred to in a Ministerial guideline and known as the flying start capital assistance scheme, the criteria are— (a) the condition and extent of the school’s existing facilities; and (b) the facilities that are, or are likely to be, needed to provide the school’s curriculum, or proposed curriculum; and (c) how many year 7 students are expected to attend the school in 2015, excluding overseas students paying full fees; and (d) the characteristics of the students who attend, or are expected to attend, the school, including, for example, whether they have particular needs; and Page 2 2012 SL No. 31

Education (Capital Assistance) Amendment Regulation (No. 1) 2012 [s 4] (e) whether the school is in a remote area of the State. ‘(2) In this section— overseas student means a person who— (a) is not an Australian resident; or (b) holds a student visa issued under the Migration Act 1958 (Cwlth).’.
