Education and Training Reform Amendment (COVID-19 Emergency Measures) Regulations 2020

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Education and Training Reform Regulations 2017 to modify the minimum standard for school registration regarding the keeping of the school attendance register in response to the COVID-19 pandemic.

2Authorising provision

These Regulations are made under section 5.10.1 of the Education and Training Reform Act 2006.

3New Part 13 inserted

After Part 12 of the Education and Training Reform Regulations 2017[1] insert¾

"Part 13—COVID-19 emergency measures

121Minimum standard for recording attendance—COVID-19 emergency period

(1)This regulation applies—

(a)in respect of all registered schools for the period of the school term during which a direction under section 200 of the Public Health and Wellbeing Act 2008 is given to limit attendance at school; and

(b)in respect of a registered school or class of registered school declared by the Secretary under regulation 122 for the period set out in the declaration.

(2)Despite clause 11 of Schedule 4, it is sufficient compliance with the minimum standard for recording attendance set out in that clause if a registered school maintains a student attendance register in which—

(a)the attendance of any student of compulsory school age is noted at least once on each school day; and

(b)any reason given or apparent for the absence of the student is noted.

122Secretary may declare school for the purposes of regulation 121

(1)The Secretary may, by notice in the Government Gazette, declare a registered school or class of registered school to be a school to which regulation 121 applies.

(2)A declaration under this regulation must specify the period (not exceeding 31 December 2020) for which regulation 121 applies in respect of the school.

(3)In making a declaration under this regulation, the Secretary must have regard to—

(a)any relevant advice of the Chief Health Officer (within the meaning of the Public Health and Wellbeing Act 2008) in relation to managing or responding to the COVID-19 pandemic; and

(b)any relevant directions of an authorised officer under Part 10 of the Public Health and Wellbeing Act 2008 in relation to the COVID-19 pandemic; and

(c)any other consideration relevant to managing or responding to the COVID‑19 pandemic in relation to the provision of school education.

123Revocation of Part

This Part is revoked on 31 December 2020.".
