The Education Council has made the following regulations under sections 301 and 324 of the Education and Care Services
National Law as applied by the law of the States and Territories.

Education and Care Services National Amendment Regulations 2015
1 Title
These Regulations may be cited as the Education and Care Services
National Amendment Regulations 2015.
2 Authorising provisions
These Regulations are made under sections 301 and 324 of the Education and Care Services National Law.
3 Commencement
(1) These Regulations (except regulation 4) commence on the day on
which they are published on the NSW Legislation website.
(2) Regulation 4 commences on 1 March 2016.
4 Health information to be kept in enrolment record
(1) In regulation 162(h) of the Education and Care Services National
Regulations, for "Wales." substitute "Wales; and".
(2) After regulation 162(h) of the Education and Care Services National
Regulations, insert—
"(i) in relation to Victoria—
(i) an immunisation status certificate within the meaning of section 147 of the Public Health and Wellbeing Act 2008 of Victoria that is issued to a child enrolled at an education and care service other than a service (or any part of a service) that is not an early childhood service as defined under the Public Health and Wellbeing Act 2008 of Victoria; or
Note the Public Health and
The definition of early childhood service under service or a school holiday care service.
(ii) details of any exemption in relation to a child under section 143C of the Public Health and Wellbeing Act
2008 of Victoria.".
5 General qualification for educators—centre-based services
In regulation 264(1) of the Education and Care Services National
Regulations, for "2015" substitute "2017".
