Education and Care Services National Amendment Regulations (No. 2) 2015

Made by the deputy of the Governor in Executive Council.

1.            Citation

These regulations are the Education and Care Services National
Amendment Regulations (No. 2) 2015.

2.            Commencement

These regulations come into operation as follows —

(a)	regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on 1 August 2015.

3.            Regulations amended

These regulations amend the Education and Care Services
National Regulations 2012.

4.            Regulation 123 amended

(1) After subregulation (1) insert:

(2A) Despite regulation 122, if an educator at a centre-based

service is not working directly with children, that
educator is counted as an educator at the service for the

purposes of this regulation if —

(a)	the educator is present on the premises of the service; and
(b)	the educator is available immediately to provide education and care to the children at

(c) the period of time during which the educator is

not working with children is not more than

30 minutes in a day.

(2) In regulation 123 in the 2" note delete "372, 374 and 374A.- and

insert:

372 and 374.

5.            Regulation 374A deleted

Delete regulation 374A.
